Falmouth Both Wind Turbines Impaired Loss $ 8,909,046.00

Barnstable Superior Court Judge Cornelius Moriarty on June 17, 2017, agreed with the Falmouth Zoning Board the Falmouth both wind turbines are a nuisance. The Falmouth Select-board the chief executive and policy-making body of the Town of Falmouth voted not to appeal the decision. On July 10, 2017, Susan Moran, the chairwoman of the Board of Selectmen, said: "It's time to put the matter behind us and move forward."
Under the Falmouth bylaws, a year-long inactivity constitutes abandonment under Falmouth’s wind energy bylaw and trigger a requirement it is dismantled and removed. Falmouth has had major issues selectively picking which zoning and bylaws are applicable to the wind turbines.
At one point Town Meeting was approving up to $ 300,000.00 every six months for wind turbine litigation. The next wind turbine litigation case is on October 2, 2018. The Town of Falmouth needs a full accounting of how much taxpayers have shelled out since 2010.
