The Falmouth Economic Industrial Corporation under the state and federal renewable energy regulations must identify who will purchase the power from phase two of the Solar fields before construction starts.
Falmouth Town Manager Julian Suso is between a rock and a hard place today. The Town Manager is the chief administrative officer of the town and carries out the policies and goals of the Board of Selectmen.
The Town Manager can't make a decision on buying up to 2 megawatts of Solar power before he finds out if the wind turbines will ever operate again.
The Select Board has to make that decision and those decisions usually end up in court at taxpayer expense for years but what the hey it's not their money .
Falmouth is involved in as many as eleven litigation cases over the wind turbines spending up to $300,000.00 every six months on an Army of attorneys. What's the difference if they hire another law firm or just throw the work out to one of the law firms already working for the town.
The Falmouth Select Board filed yet another wind turbine law suit in Massachusetts land court April 28, 2016. The discovery period closes on October 31, 2016. That lawsuit against its own Zoning Board of Appeals has been enjoined with the residents who live around the wind turbines. This case is on the fast track which could take 12 to 16 months.
The Falmouth Select Board is hoping the town insurer the Massachusetts Interlocal Insurance Association (MIIA) will pay to settle wind turbine claims. A payment by MIIA will bring twenty one other towns into negotiations over poorly placed wind turbines in Massachusetts.
The MIIA has never paid an insurance claim on a wind turbine.
Falmouth is ground zero for poorly placed wind turbines in North America.The simple facts are the town hid documents that involved the health and safety of residents of Falmouth which they according to the former acting town manager knew it was a risk but Falmouth is a large town and can afford to take that risk. The town admitted it could gamble with taxpayer funds
Falmouth Town Meeting approved in 2016 to hire Citizens Energy Corporation, a non-profit energy firm.
The Falmouth Economic Development and Industrial Corporation (Falmouth EDIC) moved after the town meeting vote to construct a 5 ( Five ) megawatt solar project at the town's capped landfill.
The residents and commercial businesses of Falmouth can rest assured of one thing. The Solar projects appear to be heading in the same direction as the wind turbines.
