The District of Massachusetts handles the prosecution of all federal crimes and the litigation of all civil matters in which the federal government has an interest:
A. Civil rights violations of Falmouth wind turbine abutters under the federal Section 1983 enacted on April 20, 1871, as part of the Civil Rights Act of 1871.

B. The illegal use of American Recovery and Reinvestment Act of 2009 (ARRA) funds known as stimulus funds to build a second wind turbine in Falmouth known as Falmouth Wind II.
C. Misrepresentations in the federal EPA waiver to buy a second foreign made Vestas wind turbine after a domestic company refused because of residential setbacks and ice throw to a nearby highway

EPA waiver
"Based on information provided to the EPA, --------- the Town of Falmouth has taken the necessary steps to obtain all required local, state, and federal approvals to move forward with the proposed project. The Town of Falmouth has adopted a local ordinance regulating large scale wind turbines. According to the submittal, Zoning Article XXXIV, Chapter 240, Section 240–166 requires a Special Permit for windmills with minimum setback from property lines."

The Town of Falmouth, Massachusetts has a KEMA Inc 2005 noise map for Falmouth Wind I that showed decibel levels over 40 decibels of noise on Black Smith Shop Road. General Electric a domestic wind turbine company refused to place a single 103.5-decibel wind turbine because of residential setbacks and ice throw to a nearby highway.
The Town of Falmouth withheld a warning letter that the Vestas 110 decibel wind turbines are twice as loud from the public and never disclosed the letter until 2013 years after the installations. Placing the foreign made wind turbine raised decibel levels near 60 decibels on Blacksmith Shop Road.
The KEMA Inc map, emails, and warning letter show the town should have filed Special Permit 240 -166 as stated in the Federal EPA waiver.
The Falmouth zoning board determined both wind turbines are a nuisance and on June 20, 2017 the Barnstable Superior Court agreed with the Falmouth zoning board and shut down both wind turbines.
The town hid or omitted information regarding the health and safety of up to 200 residential homeowners. The information includes letters, emails, maps, and memos.
The Town of Falmouth never filed Special Permit 240-166 as would require additional notifications to wind turbine abutters and Falmouth Zoning Board of Appeals in which case the turbines would never be built.
The Federal EPA should never have approved the waiver for Falmouth to buy a second wind turbine after the Falmouth Board of Health receiving hundreds of written certified noise complaints from the first turbine
The Town of Falmouth had the documentation prior to the installation and loan/grant for Falmouth Wind II that the turbines generate 110 decibels of noise.
The Town has NO noise study tests for both Falmouth Wind I and Wind II operating together.
The Falmouth, Massachusetts industrial wind is a bunco scheme of enormous consequence. The residents, voters and people who value intellectual honesty should not quietly be fleeced by such mendacity, even from their own government.
