Massachusetts Dept of Environmental Protection Brokered A 5 Million Loan Through the Massachusetts Clean Water Trust using the State Revolving Fund Called A Project Regulatory Agreement on Falmouth Wind II.

Deborah B. Goldberg is the Massachusetts State Treasurer and Receiver General. In that role she is responsible for the state’s cash and debt management, unclaimed property, and chairs state boards and commissions, including the Massachusetts Clean Water Trust.

All the state funds were derived from the federal ARRA American Recovery and Reinvestment Act of 2009

The letter followed up on the telephone call by Commissioner Kenneth Kimmell, of the Department of Environmental Protection, to Julian Suso, the Town Manager of Falmouth, Massachusetts (the "Town") on Friday, March 29, 2013 concerning the Wind Turbine project at the Town's wastewater treatment facility ("Wind II") that was funded with money provided through the American Recovery and Reinvestment Act of 2009 ("ARRA").

The Massachusetts Clean Water Trust will require that the Town enters into an agreement to operate Wind II at a level that permits it to continue to qualify as an "energy efficiency" project in accordance with DEP requirements for the duration of the Loan.

The Massachusetts courts shut down the nuisance Falmouth Wind II on June 17, 2017. American Recovery Reinvestment Act of 2009 stimulus funds cannot be used if a substantial and specific danger to public health or safety.

According to the MassDEP PRA, Project Regulatory Agreement, in the event that the project ceases to function as an energy efficient project, the Trust will amend Schedule C to reinstate the Town's obligation to pay principal and interest on the Loan and take such other actions as it deems necessary or appropriate to ensure compliance with Federal Law, the PRA, and the Loan Agreement.
