Turbine Removal Time Has Come - Letter
Wind 1 has been dormant since Falmouth’s Zoning Board of Appeals ordered a cease-and-desist ruling in September 2015. According to Falmouth’s Wind Energy System Bylaw § 240-166 K (5) (a) [4]: “… Absent notice of a proposed date of decommissioning, the WES (Wind Energy System) shall be considered abandoned when the facility fails to operate for more than 12 consecutive months.”
Why hasn’t the zoning enforcement officer (Falmouth’s building commissioner) ordered the removal of this structure? Falmouth’s ZBA denied a special permit in April 2016 and the town did not appeal the subsequent court ruling. Yet, the Wind 1 structure remains.

It’s beyond the time to remove one of the mistakenly placed turbines. Wind 2’s removal will be June, 2018, one year from the Moriarty decision. Unless of course, selectmen’s executive meeting discussions are attempting to circumvent zoning bylaw and the will of Town Meeting.
Is there a plan by the board to preserve a way of using the wind turbines in violation of the will of Town Meeting’s bylaw?
