Falmouth Turbines Hit Building Commissioner & Zoning Enforcement

Falmouth Building Commissioner has referred a request to Town Council Attorney Frank Duffy. The Town of Falmouth has 14 days to reply

The Massachusetts Superior Court in June of 2017 agreed with the Falmouth Zoning Board the wind turbines are a nuisance shutting down the turbines permanently

The Falmouth Select Board, the legal owners of the wind turbines, voted not to appeal the June 2017 ruling by the Falmouth Zoning Board and the Massachusetts Superior Court that the turbines are a nuisance.

Falmouth Chairwoman Susan Moran said about the wind turbines in July of 2017: "It's time to put the matter behind us and move forward."

The Falmouth Select Board has abandoned the turbines in which case town regulations require the removal by the Building Commissioner & Zoning Enforcement Officer

Falmouth wind turbine number one has been dormant since Falmouth's Zoning Board of Appeals ordered a cease-and-desist ruling in September 2015. According to Falmouth's Wind Energy System Bylaw § 240-166 K (5) (a) [4]: "… Absent notice of a proposed date of decommissioning, the WES (Wind Energy System) shall be considered abandoned when the facility fails to operate for more than 12 consecutive months."

Today the zoning enforcement officer (Falmouth's building commissioner) has been asked by residents to enforce town regulations the removal of this structure. Falmouth's Zoning Board of Appeals denied a special permit in April 2016 and the town did not appeal the subsequent court ruling.

It's time to remove, Falmouth Wind 1, one of the mistakenly placed turbines. Wind 2's removal will be June 2018, one year after the Judge Moriarty decision.

The Falmouth Building Commissioner has referred the request to Town Council Attorney Frank Duffy.
