The case will be heard by a full court panel case by Judges Rubin, Wolohojian, and Blake on October 2, 2018 at the John Adams Courthouse, Courtroom 4, Third Floor, Pemberton Square, Boston, MA 02108
The name of the case is: TOWN OF FALMOUTH vs. FALMOUTH ZONING BOARD OF APPEALS & others case # 2018-P-0104

Barnstable Superior Court Judge Cornelius Moriarty issued the order to shut down Falmouth's Wind 1 and Wind 2 on June 20, 2017. The judge denied the appeal brought by Falmouth selectmen against the Zoning Board of Appeals.
The Falmouth Zoning Board of Appeals had found the turbines to be a "nuisance."
The Friends of Falmouth Wind waited until the end of 2017 to file an appeal. The court ruled the Friends of Falmouth waited far past the appeal date and have no standing. The trial began in January of 2014 over, four, 4 years ago.
The " Friends of Falmouth Wind " only got involved when the Falmouth Board of Select Board voted Monday in July of 2017 not to appeal a judge’s decision ordering the shutdown of the town’s two horrendous Vestas V-82 nuisance wind turbines.
Chairwoman Susan Moran acknowledged they had lost the case and said: “It’s time to put the matter behind us and move forward."
