Mediation and arbitration are frequently-used legal processes known as Alternative Dispute Resolution or Conflict Resolution.
Attorneys law firms use techniques to assist individuals and entities in resolving matters in a neutral, efficient manner.
The best staff of arbiters is usually composed exclusively of former judges.
Former judges generally avoid presenting choices to plaintiffs such as A, B or C as in general most plaintiffs will select D none of the above.
The weaknesses in the Town of Falmouth party’s position is
(A) August 2010 Vestas noise warning letter hidden by the Town of Falmouth for five years
(B) The $139,000.00 taxpayer funded 2012 Falmouth Wind Turbine Option Analysis Process (WTOP) to engage in an open, transparent, and collaborative exploration of the range of options for the long-term future of the Town’s two Wind Turbines – Wind I and Wind II. The town hid the Vestas 2010 noise warnings and associated emails.
(C) The November 7 2013 verbal court agreement with Town Attorney Frank Duffy and Select Board Member Rebecca Moffit which the town one week later refused to honor.
(D) The Town of Falmouth has taken the action and practice of knowingly inflicting pain which is described by the Massachusetts Clean Energy Center as two distinct types of noise from the commercial wind turbines. Those types of noise are regulatory and human annoyance as described in noise studies for 110 decibel Vestas V-82 commercial 1.65 megawatt turbines such as those in Falmouth.
The noise is described as torture from lack of sleep :
“The Town has previously been provided with the Octave Band Data / Sound performance for the V82 turbine. This shows that the turbine normally operates at 103.2dB but the manufacturer has also stated that it may produce up to 110dB under certain circumstances.”
