Falmouth Wind Turbine Lawsuit -A Lawsuit That Can Not Be Won Because Something As Simple As A 2005 Noise Map Shows The Entire Project Was Flawed From Day One And Should Never Have Been Built.
The Massachusetts Clean Energy Center has dumped another 1.8 million into this flawed project in 2013 and Falmouth taxpayers are dumping up to $300,000.00 every six months on litigation fees at Town Meeting.

In March of 2010 Falmouth Wind I was officially commissioned and noise complaints began.
The 2005 Falmouth study was Prepared by: KEMA, Inc. & Ecology and Environment, Inc. and funded by the Community Wind Collaborative of the Renewable Energy Trust
The KEMA Inc map in this study was done in 2005, years prior to the installation of Falmouth Wind I.
The sound predictions in the pressure contour map are for one General Electric 103 decibel wind turbine.
The Massachusetts Clean Energy Center in April of 2013 in a memo admitted the acoustic noise levels using a General Electric wind turbine were too low.
The 2005 KEMA Inc map using General Electric 103 decibel turbines predicted exceedance of local 40 decibel (“dB A”) limit at property lines.
The map indicated noise studies be studied in fuller detail as part of the Special Permit process that was never done by the town.
The town further compounded the decibel levels on the KEMA Inc 2005 map by installing a Vestas wind turbine with a 110 decibel noise rating. The Vestas installation increase the sound predictions on the contour map by seven decibels.
The seven decibels on a decibel scale level doubles the sound to the human ear. In other words the Vestas turbine is double the noise level of a General Electric wind turbine. There was never a new map designed to reflect the louder Vestas turbine.
A 103 decibel wind turbine sounds like a lawn mower.
A 110 decibel wind turbine equals a hard rock band 24/7
The Town of Falmouth had a written noise warning letter and emails in 2010 that the Vestas turbine was twice as loud as the General Electric wind turbine.
The 2005 KEMA Inc map shows noise levels exceeded 40 decibels on Black Smith Shop Road.

The Town of Falmouth installed 110 decibel Vestas wind turbines that are twice as loud as the map projections using General Electric turbines that exceed 40 decibels on Black Smith Shop Road
This is a case that can not win. There are far too many hidden documents, emails, memos, letters, and maps -------this map
