The wind turbine trial started on Monday September 12. The court has scheduled the trial to last up until Friday September 16.
This case one of up to eleven litigation cases against the wind turbines was filed on June 5, 2013.

The case is on what is called the Fast Track for Massachusetts litigation cases.
The trial is taking place in Barnstable Superior Courtroom 2
The town failed to agree during wind mediation in 2012. The Consensus Building Institute CBI was paid just under $139,000.00, for an assessment; designing and convening the process; preparing for, traveling to, facilitating and documenting 24 meetings in an effort to resolve the illegal taking of health and property rights.Massachusetts taxpayers paid for the mediation.
On November 7 of 2013 Town counsel Frank K. Duffy and former select board member Rebecca Moffitt, representing the town of Falmouth , came to an agreement in Barnstable Superior Court but then walked away from the agreement one week later
Monday July 25, 2016 as the Town of Falmouth faces eleven ongoing lawsuits over the turbines the Falmouth Select Board has again requested a “global solution” to the wind turbine health and financial fiasco.
The Town of Falmouth for five years from 2010 to 2015 hid a noise warning letter from Vestas wind turbine company.The letter spelled out that the turbine was twice as loud as a General Electric turbine used in a 2005 study.
Many call the Vestas noise warning letter the Smoking Gun which has led to the abuse of taxpayer funds used to try to outspend the up to 200 residential home owners around the turbines
Falmouth is spending up to $300,000.00 every six months on litigation and has lost every case while the residents continue to lose health , property rights and their properties continue to lose value.
The Consensus Building Institute (CBI) has confirmed the Vestas 2010 noise warning of 110 decibels never disclosed by the Town of Falmouth during open transparent 26 meetings costing taxpayers $139,000.00

“The Town has previously been provided with the Octave Band Data / Sound performance for the V82 turbine. This shows that the turbine normally operates at 103.2dB but the manufacturer has also stated that it may produce up to 110dB under certain circumstances.”
