Falmouth Wind Turbines A 20 Million Dollar Screw Up

The government needs responsibility for wrongs to residents using ARRA funds that created a substantial and specific danger to health safety

The government needs to be held responsible for wrongs to the residents of Falmouth using ARRA funds that created a substantial and specific danger to public health and safety.

ARRA funds were intended to buy American and put Americans to work. So how did Falmouth end up with two foreign-made Vestas wind turbines after General Electric a domestic wind company refused to place a single wind turbine because of setbacks to residential homes and ice throw. One simple word: "Corruption"

For eight years federal, state and local officials hid the fact the Town of Falmouth installed Vestas wind turbine that they knew generated 110 decibels of noise. There are dirty hands at every level of government, and local residents who defended their health and homes should be reimbursed for all the eight years of litigation.

Investigations need to proceed into why local, state, and federal officials failed to prevent the problem of issuing 5.3 million dollars in ARRA, American Recovery and Reinvestment Act of 2009 funds, to take health and property to create a substantial and specific danger to public health and safety.

Politicians failed to act long before and after they knew of the 110-decibel noise warnings. All citizen, leaders, and advocates need to call on state and federal government for relief and restitution in a variety of ways.

Massachusetts can not claim sovereign immunity. Under the federal constitution, the federal, state and local government infringed on the fundamental civil right to bodily integrity.

Falmouth citizens long before the wind turbines in search of the American dream of home ownership purchased or built homes in the residential zoned locations around the Wastewater Treatment Plant. The American dream conveys a number of economic benefits, such as the ability to accumulate wealth and access credit by building home equity, reduce housing costs through the mortgage interest deduction, and gain long-term savings over the cost of renting.

Many of these residential homeowners spent their life savings on litigation defending their health and property rights against an agenda which misused ARRA, federal funds to install 110-decibel wind turbines.

A victim compensation fund needs to be established as well as holding the chain of politicians who acted with a wink and a nod criminally responsible.

A. # 5.3 Million Dollar ARRA Loan/Grant with a Project Regulatory Agreement written by the Massachusetts Department of Environmental Protection funded through the Massachusetts State Reserve Fund by the Massachusetts Clean Water Trust.

# A bogus federal EPA waiver to buy foreign wind turbines after General Electric refused because of residential setbacks and safety - Original Statutory Requirement Summary (ARRA Title XVI, Section 1605)

B. 15 Million used to hire multiple Boston law firms, ongoing wind studies, and engineering firms.

C. 2 Vestas V-82 type 1.65 megawatt wind turbines each producing 110 decibels of noise equal to a hard rock band.

Total 20 Million -- Everyone made money except the taxpayers.

June 2009, Falmouth Town Meeting Members approved an article at Special Town Meeting to allow Town of Falmouth Select Board to borrow money or accept grants or any other means to build Falmouth Wind Turbine II.

The minutes of that Special Town Meeting show Town Meeting Members were told: " This is the federal stimulus money that you’ve heard so much. "

How did this 5 million become an energy production agreement that was brokered by the Massachusetts Department Environmental Protection? This agreement required the Massachusetts Clean Water Trust to lend 5 million dollars out of the State Reserve Fund that the state had received in ARRA, American Recovery and Reinvestment Act of 2009 funds and lend it to buy Falmouth Wind II.

The federal government ( you the taxpayer) gave the state of Massachusetts 5 million dollars. The state then lent it to the Town of Falmouth and now (you the taxpayer) are paying back a loan of your own money.
