In 2013 the Falmouth Select Board voted unanimously to have the town vote to remove the two Vestas V-82 commercial 1.65 megawatt turbines for good reason. At the time prior to the town wide vote town officials had a 110 decibels 2010 noise warning letter from Vestas,an April 2, 2013 memo from the Massachusetts Clean Energy Center admitting under estimating acoustic tests in residential homes around the wind turbines, a 2005 KEMA Inc map showing noise above 40 decibels on Black Smith Shop Road and various emails about noise.
Much of the negative documentation of the wind turbines was never made available to the voting public in 2013. Thanks to the Freedom of Information Act all the documents are in the hands of the legal counsel to those being caused headaches, nausea, and other physical ailments.

Since the turbines were installed the Massachusetts Clean Energy Center has provided an additional 1.8 million through renegotiation of the town renewable energy contract in part to cover legal expenses. Falmouth Town Meeting has been approving up to $300,000.00 every six months for additional legal firms. The residents around the turbines are paying for their own lawyers with no help from the Massachusetts Clean Energy Center.
The Massachusetts Clean Energy Center has in effect by providing legal assistance to only the town and not the neighbors has made itself judge and jury trying to outspend residential home owners with renewable energy taxes paid by Massachusetts residential and commercial electric rate payers.
The Massachusetts Clean Energy Center knew the turbines generate 110 decibels of noise prior to installation and admitted (April 2, 2013) acoustic noise mistakes in 2005 preliminary tests. So why only pay one side of a litigation case unless you have an agenda. The agenda is 2000 megawatts of renewable energy by the year 2020 no matter who gets in the way -NIMBY -Next It May Be You ! They are taking your health and property with your own taxes !
The litigation fees have exceeded the original purchase price of Falmouth Wind I. With eight or nine wind turbine lawsuits remaining some not yet assigned it appears the litigation fees will surpass the purchase price of both turbines.
The neighbors of the turbines are losing their health and property rights while the town spends millions on wind turbine litigation
The Massachusetts Clean Energy Center only wants to count the 3 megawatts of Falmouth wind turbine power towards its renewable energy goal and keep the turbines up because twenty one other communities are having the same problems. Taking down the Falmouth wind turbines will create a domino effect across the state.
The only ones making money are the lawyers be prepared to get out your wallets for what's left in the life of the gear driven wind turbines.
This is no longer about renewable energy -It's about feeding law firms !
