"Friends of Falmouth Wind" File More Wind Turbine Litigation Against Town

Falmouth Town Meeting meets 11/6/17. Town Officials Need To Produce All Wind Turbine Documents Including Warning Letters -Emails-Memos-Maps

Anonymous sources close to Falmouth town government has rumored the Falmouth Town Attorney has recently received communications over additional wind turbine litigation.

The Falmouth Selectboard decided not to appeal the June 2017 Barnstable Superior Court Judge Cornelius Moriarty court order to shut down the nuisance turbines.

The judge upheld the decision by the Falmouth Zoning Board of Appeals the turbines are a nuisance.

The Falmouth Zoning Board is a semi-judicial board appointed by the Selectboard ruled the wind turbines are a nuisance.The judge approved the finding and the time to appeal has ended causing other litigation to be consolidated.

Chairwoman Susan Moran said: “It's time to put the matter behind us and move forward.”

Falmouth Selectboard members were approached individually after the court decision by members of "Friends of Falmouth Wind." The so-called "Friends" urged the board file
an appeal using taxpayer dollars. The board members rejected the proposals.

It's unclear at the moment what type of litigation the Town of Falmouth has received as the time to appeal the case June 2017 has long passed along with other litigation as a result of no appeal.

In the past public officials withheld a letter, memo, map, and emails the turbines were too loud. In particular, an August 2010 letter from Vestas wind company the manufacturer of the turbines that they generate a chest pounding 110 decibels of noise. Twice as loud as those used in noise models prior to construction.

The issue of taking things out of context or cherry-picking wind turbine data has been a major problem. The time has come to make all the wind turbine documents public and stop hiding the warning letters, memos,maps and emails that have already been exposed it court proceedings.

Time to put all the information on the town website so the public can understand what a health and financial fiasco took place over the last eight years
