"Friends of Falmouth Wind" Fooling Mass State Appeals Court

"Friends of Falmouth Wind" a cult: common sense, logic, and reason are being sacrificed on the altar of eco-lunacy at taxpayer expense.

After eight years the courts have slowly been shutting down the Falmouth towns owned wind turbines. On June 20,2017 Judge Moriarty agreed with the Falmouth Zoning Board of Appeals that the turbines are a nuisance and shut them down.

The Friends of Falmouth Wind filed their appeal 5 months too late and the courts ruled they have NO standing. The appeal number to the Massachusetts Appeals Court is 2018-P-0104.

The Friends are using as an argument in their appeal to the courts that in 2007 the Massachusetts Legislature passed a bill that said: "the town of Falmouth may design and install wind energy facilities at its wastewater treatment facility at Blacksmith Shop road in the town, prepare and improve the site, acquire all equipment necessary for the wind energy facilities, make improvements and extraordinary repairs to the facilities and pay all costs incidental and related thereto."

The Friends of Falmouth Wind in an effort to fool the Massachusetts Superior Courts omitted the first part of the 2007 legislation in their appeal: "Notwithstanding any general or special law to the contrary." This statement was left out of their appeal to the Massachusetts Superior Court.

This is not the first time members of Falmouth Wind have omitted documentation from litigation.

The Town of Falmouth requires special permits and additional notifications to abutters of the wind turbines this is contrary to the 2007 Massachusetts legislation. Who is fooling who?

Tonight Tuesday, April 10, 2018, the Friends of Falmouth Wind plan to oppose Article 19 :

"ARTICLE 19: To see if the Town will vote to appropriate a sum of money to pay for the Town’s obligation pursuant to the Mass CEC agreement relating to the Wind Turbines, to determine how the same shall be raised and by whom expended. Or do or take any other action on the matter. On request of the Board of Selectmen."

"RECOMMENDATION (Finance Committee): That the Town vote to transfer the sum of $178,070 from certified free cash for the purposes of this article. Said funds to be expended under the jurisdiction of the Town Manager."
