"Friends of Falmouth Wind" Put 5 Million ARRA Loan In Jeopardy

Taxpayers have to remember these are not mistakes. There are far too many so-called "mistakes." This is intentional and your paying for it!

Number 1 : Massachusetts Attorney General Maura Healey and A federal prosecutor could convene a federal grand jury to look at the evidence in all the Falmouth wind turbine litigation. That evidence includes warning letters, memos, maps, emails and the EPA waiver to buy a foreign wind turbine with stimulus money which includes:

Massachusetts DEP approved "Project Regulatory Agreement" with the Town of Falmouth.

On June 20, 2017 Massachusetts Superior Court Judge Cornelius J. Moriarty II affirmed the Falmouth Zoning Board of Appeals’ position on turbines Wind 1 and Wind 2 they are a nuisance. The turbines are shut down.

The Falmouth Zoning Board of Appeals and the Massachusetts Superior Court has warning letters, maps, memos, emails and documents showing the turbines should never be built. The public has never seen much of the documentation. The failure to release the information was not a mistake. It was intentional and took the health and property rights of up to 200 residential homeowners.

In July the Falmouth Select Board met and decided not to appeal the court decision. Chairwoman Susan Moran said: “It's time to put the matter behind us and move forward.” The Falmouth Select Board every week since the decision not to appeal the court decision puts wind turbine negotiations with neighbors on the agenda in Executive Session.

Because of the Falmouth Select Board not appealing the case according to Susan Perez, executive director of the Massachusetts Clean Water Trust - Falmouth gets a 3 million financial interest break from the loan/grant program established under the American Recovery and Reinvestment Act of 2009.

Massachusetts Clean Water Trust Trustees voted the loan reduction believing litigation was over and wind turbines ordered permanently shut down in June by a Massachusetts Superior Court judge because it was a nuisance to neighbors.

The American Recovery and Reinvestment Act loan/grant financing had always been a problem with Falmouth Wind II because an EPA waiver to buy a second foreign made Vestas wind turbine was approved after General Electric a domestic wind turbine company refused to build a single wind turbine because of residential setbacks and ice throw.

The American Recovery and Reinvestment Act was designed to buy American and put Americans to work not to install foreign made 110 decibel wind turbines taking Americans health and property rights.

Now comes the "Friends of Falmouth Wind." On October 30, 2017 five months after the Massachusetts Judge Cornelius J. Moriarty decision has filed a "Motion to Intervene."

The "Friends of Falmouth Wind" believe they have a right to negotiate the determination the Falmouth wind turbines are a nuisance and want continued operation of the turbines.

According to the Falmouth town attorney, the Falmouth Zoning Board has hired an attorney to look into the "Motion to Intervene" by the "Friends of Falmouth Wind." We all know who is paying for this -you the taxpayers. Falmouth Town Meeting has approved up to $300,000.00 every six months in legal fees to justify the turbines.

The Massachusetts Clean Water Trust Trustees and the Executive Director Susan Perez could soon find themselves between a rock and a hard place as well as the taxpayers in Falmouth.

Ultimately this should draw attention to how the American Recovery and Reinvestment Act, stimulus funds, were used to build Falmouth Wind II and now in 2017 the interest of those funds was dropped while litigation was filed by the"Friends of Falmouth Wind."

TheTown of Falmouth government has failed for seven years to introduce effective controls on wind turbine noise emissions.

In addition, the Town of Falmouth located wind turbines too close to homes, exposing families to serious and material violations of family health, to loss of dignity, to inhumane treatment, and to loss of the amenity of family homes.
