Man Accused Of Shooting 2 Falmouth Cops Will Take Plea Deal

Mark Koval, 23, of East Falmouth, will serve 8-12 years in prison after admitting he shot and injured two Falmouth police officers.

FALMOUTH, MA — A man prosecutors said shot and injured two Falmouth police officers will enter a plea deal after initially arguing for a lesser sentence.

Originally, the attorney for Mark Koval, 23, of East Falmouth argued for a lesser sentence, arguing the exchange of gunfire stemmed from an "overreaction" by police and his client's possible mental health issues. But the Cape Cod Times reported Koval will agree to a deal that will give him an 8-to-12 -year prison sentence rather than the 5- to 7½-year sentence Attorney Brian Kelley had argued for.

"My client has had the time to think about that," Kelley said. "Mr. Koval is resolute on taking responsibility and moving on from this case."

The case stemmed from a July 2018 shooting, where prosecutors said Koval shot officers Don DeMiranda and Ryan Moore in the Seacoast Shores neighborhood. Koval became agitated when the officers, who were responding to a call of a man breaking bottles in the street, confronted him, according to police.

Prosecutors said Koval went into his house, got a gun and fired at the officers. DeMiranda was shot in the chest and shoulder, and Moore was shot in the neck. Koval was then shot several times but survived.
