Massachusetts DEP Guilty Wind Turbine Noise Described As Torture

MassDEP Created Second Class Wind Turbine Citizens - Your Health and Safety Took A Back Seat - Health & Property Taken No Compensation

The Massachusetts Department of Environment Protection since 2008 has acted as the architect of publicly funded wind turbines. The MassDEP in many wind turbine financial legal documents is referred to as the " The Department. "

The Massachusetts Department of Environmental Protection (MassDEP) oversees contractors and almost everything except your health and safety working on publicly funded projects financed by the State Revolving Fund (SRF) and in turn, the Massachusetts Clean Water Trust Board of Directors votes which towns get loans and grants for wind turbine projects. The loans and grants also involve long term bonding and lending agreements.

In 2009 the federal government passed the American Recovery and Reinvestment Act of 2009 (ARRA) an economic stimulus package to stimulate the economy. Massachusetts at that time had a wind turbine renewable energy goal of 2000 megawatts of wind turbine power by the year 2020. The state pulled out all the stops to implement the war on fossil fuels. The stops included your health and safety in which the MassDEP determined the environment belongs to the state agency, not you and they can sell the rights to the environment to the highest bidder. The federal government has determined the environment belongs to everyone.

The common denominator for any town receiving public loans and grants for a wind turbine is the MassDEP. The MassDEP enables all the other public financing agencies to work with the towns through an agreement known as the " Project Regulatory Agreement" aka a wind turbine renewable energy power production agreement.

The Massachusetts Department of Environmental Protection is the enabler for all public wind turbine projects putting various state agencies in touch with local town governments to make contractual agreements.

The Project Regulatory Agreement is written to ensure plans, designs, construction but above all others demands a production level and energy output from the wind turbines. The Project Regulatory Agreement agreement makes it impossible for the MassDEP to take action against wind turbine noise as it would break its own financial demands of local town governments. In other words, the MassDEP will never enforce state noise regulations against wind turbines. If your neighborhood is getting a wind turbine you need to hire an attorney immediately.

MassDEP will not take action and in a nutshell, it's the Project Regulatory Agreement as written by the MassDEP. The Project Regulatory Agreement ensures all those involved in the financial aspect of the turbines that the turbines will stay in production the life of the grants and or loans despite health complaints.

The Massachusetts Department of Environmental Protection can no longer help the citizens because of its involvement in wind turbine contracts. The citizens need to hire an attorney or in Massachusetts, class action certification is warranted against the state wide onslaught of taking health and property rights with no compensation.

The MassDEP Project Regulatory Agreement does not take into consideration public health and safety thus places the production of the wind turbines over those who live around them. In other words, it's money vs your health to achieve a wind turbine renewable energy goal.

The Massachusetts Department of Environmental Protection overseeing the installation of the commercial megawatt wind turbine has become immoral with despicable in human conduct bordering on criminal as suicides have been attributed to commercial wind turbine noise described as torture by neighbors of the turbines world wide.

We know today the Massachusetts DEP has been aware residents have been living in a toxic environment around the wind turbines.

It had been known prior to the installation of the Falmouth wind turbines they generate 110 decibels of noise.

In 2012, MassDEP released for public review the Wind Turbine Health Impact Study. In that study, it describes 110 decibels of noise as chest pounding and admits the turbines cause sleep disturbance. MassDEP sat on their hands

The Massachusetts DEP is guilty of years of failure to act as well as the Massachusetts Attorney General.

The Massachusetts Attorney General prosecutors belong to the Massachusetts Environmental Stike Force an interagency unit comprised of scientists and engineers from the Massachusetts Department of Environmental Protection (MassDEP) and State Police. The Strike Force gathers evidence during undercover investigations, carefully builds cases against alleged environmental violators, then takes them to court but not when it comes to commercial wind turbines.

The Massachusetts Clean Energy Center needs judicial oversight with its lack health and safety helping to create a state wide second class group of citizens living under the seven-ton blades. Massachusetts commercial wind is a bunco scheme of enormous health and safety consequence.The people who value intellectual honesty should not quietly be fleeced by such mendacity, even from their government officials.

The Massachusetts Constitution affirms the dignity and equality of all individuals. It forbids the creation of second-class citizens.

The Massachusetts Department of Environmental Protection since the passing of the Green Communities Act in 2008 has created a statewide second class group of citizens. Massachusetts has twenty-one communities with poorly placed commercial megawatt wind turbines.The turbines take the health and property rights of citizens with shadow flicker from the sun and two distinct types of noise regulatory and human annoyance known as infra sound.

The US Department of Energy has known about infra sound since wind turbine studies done in Boone, North Carolina in 1987.

Falmouth, Massachusetts is ground zero for poorly placed wind turbines in the United States. Here we are in 2017 thirty years later and the Massachusetts Superior Court has confirmed again the turbines cause human annoyance. The two town owned turbines are shut down.
