Massachusetts DEP Will Never Enforce Noise Regulations.They Financed The Falmouth Wind Turbine Project Wih A Power Production Agreement.

Many people wonder why the Massachusetts Department of Environmental Protection does not enforce Massachusetts noise regulations 310 CMR 7.10. The simple answer is they chose not to enforce those laws because of regulatory capture.
A regulatory capture is a form of government failure that occurs when a regulatory agency, MassDEP, created to act in the public interest of health, safety, and environment, instead advances commercial wind turbines or political concerns of special interest groups that dominate the industry or sector it is charged with regulating.
The MassDEP over the years has produced ' Project Regulatory Agreements ' with various town owned wind turbines & Solar projects. The towns have received zero percent loans to build wind turbines and solar projects. MassDEP provided loans which include multiple state agencies.

The PRA agreement is a power production agreement --If the turbines stop spinning the town has to pay back the loan of zero percent immediately. MassDEP who wrote the loan note is not going to turn around and shut down turbine for noise after it approved the loan.

For example, in the Falmouth case, the MassDEP could not enforce noise regulations as it would have stopped the " Project Regulatory Agreement " a financial agreement. Finances and state renewable agenda took precedence over health and property rights and the environment.
The MassDEP tied its own hands with the Falmouth deal and every other commercial wind project in Massachusetts
MassDEP could not force other towns around Massachusetts with commercial wind turbines to shut down as the residents who live around the Falmouth wind turbines had up to eleven ongoing lawsuits against the Town of Falmouth wind turbines.
The Falmouth residents could have shut down their turbines immediately if MassDEP took action against any of the other twenty -one community with poorly placed wind turbines taking health and property rights
1. MassDEP reneged on their legislative mandate to protect public health. (Noise regulations)
2. MassDEP now has a contract with wind developers not to enforce noise limits. ( Project Regulatory Agreements )
3. MassDEP agrees to "Regulatory Capture" by the MassCEC, along with MassDPH, Mass AG, DOER, etc.
