Misappropriation of Falmouth Wind II ARRA Federal Loan Funds Alleged
MassDEP "Project Regulatory Agreement" warns that any power reduction of the turbine will result in higher interest rates on the loan.

2009 -- 111th US Congress passes the American Recovery and Reinvestment Act of 2009. The object to save existing jobs and put Americans to work using American products. Millions of dollars are sent to Massachusetts to invest in infrastructure, education, health, and renewable energy (wind turbines). This was for shovel-ready projects.
2009 --General Electric a domestic wind turbine company refuses to build a single commercial wind turbine generating 103.5 decibels of noise in Falmouth because of setbacks to residential homes.
2010 --Town of Falmouth buys and installs Falmouth Wind I a foreign made Vestas V-82 commercial 1.65-megawatt wind turbine generating 110 chest pounding decibels of noise. Neighbors complain almost to the day of startup.

Town decides to build a second turbine Falmouth Wind II with a federal stimulus fund loan.
2010-- April: Town of Falmouth in federal register volume 75 number 80, page 22130, files an EPA waiver to buy Falmouth Wind II its second wind turbine a foreign made wind turbine with ARRA stimulus funds. The town states there are no domestic wind turbines available but leaves out the fact General Electric a domestic wind turbine company refused to build because of residential setbacks.

Federal officials approve the April 2010 EPA waiver to buy the foreign made turbine unaware the town had previously been warned both Vestas turbines produce 110 chest pounding decibels of noise.
2010-- August: The Town of Falmouth receives an official warning letter from Vestas wind turbine company that the first wind turbine installed generates 110 decibels of noise reminding the town it had previously been warned the foreign-made turbines generate too much noise near residential locations. Also, noise study noise maps from 2005, Vestas emails and memos show prior to the installation of the second Falmouth wind turbine known as Falmouth Wind II everyone was aware the turbines generate 110 decibels.
There is no noise study of both 110-decibel turbines operating at the same time.
The Massachusetts Department of Environmental Protection makes arrangement for the Town of Falmouth to borrow ARRA, American Recovery and Reinvestment Act stimulus funds through the state revolving fund called the "Project Regulatory Agreement." knowing the turbines generate 110 decibels of noise.
2010-- February : The Town of Falmouth after a Special Town Meeting signed the 62- page Falmouth Wind II Massachusetts Department of Environmental Protection "Project Regulatory Agreement" wind turbine loan agreement.

MassDEP "Project Regulatory Agreement" a wind turbine power production agreement ignores state regulatory noise, safety and health. Agreement intentionally has no legislative public safety issues addressed only a wind turbine production agenda.
First, the federal officials should never have approved an EPA waiver to buy a foreign wind turbine after General Electric a domestic wind company refused to build a smaller turbine that on the decibel scale generates half the noise of the foreign-made Vestas V-82.
Second, the Massachusetts Department of Environmental Protection should never have provided a "Project Regulatory Agreement " and ARRA stimulus fund loan through the state revolving funds to the Town of Falmouth as the MassDEP is charged to enforce state noise regulations MassDEP's Air Pollution Control Regulations, 310 CMR 7.00.
This is clearly a conflict of interest.
The Massachusetts Department of Environmental Protection was fully aware the Falmouth wind turbines generated 110 chest pounding decibels of noise and had to know that two turbines operating at the same time would undoubtedly break their own air pollution regulations.
The Massachusetts Department of Environmental Protection has never taken action against any wind turbine in Massachusetts because of the conflict of interest between state noise regulations and the MassDEP "Project Regulatory Agreement ."
Finally, These are not mistakes.
The financing of Falmouth Wind II a turbine known to produce 110 decibels of noise was a loan process that took almost two years. Everyone including state and town officials was aware the turbines should never have been built.
State and local officials took the health and property rights of citizens and hid the noise warning letter, maps, memos and emails from the public.
Massachusetts Superior Court Judge Cornelius Moriarty on June 20, 2017 agreed with the Falmouth Zoning Board the turbines are a nuisance and shut down both turbines.
Massachusetts commercial wind is a bunco scheme of enormous consequence. The citizens who value intellectual honesty should not quietly be fleeced by such mendacity, even from their government officials.
These politicians and appointed officials have to be held accountable
