Oversight in group’s motion in turbine case slows court action

FALMOUTH — An effort to get Falmouth’s two controversial wind turbines spinning again is off to a slow start. The environmental group Green Center is seeking a hearing in Barnstable Superior Court to reconsider a judge’s recent decision to shut down the turbines because they were a nuisance to abutters. The group, hoping to lobby for some alternative to total shutdown, filed a motion to intervene, but failed to provide a copy to the town’s Zoning Board. According to Falmouth Town Counsel Frank Duffy, that oversight has slowed court action by about two weeks, since the Zoning Board must be given time to provide comment. Land use attorney Mark Bobrowski will represent the Zoning Board.

While Judge Cornelius Moriarty ordered the turbines shut down June 20, the Green Center said it did not file the motion earlier because it wasn’t apparent that taxpayers weren’t being properly represented until after the turbine trial, the judge’s ruling and the selectmen’s decision not to appeal.
