Town of Falmouth Misled EPA Over Wind Turbine II Waiver:

Notice of a Regional Project Waiver of Section 1605 (Buy American) of the ARRA 2009 to the Town of Falmouth, MA

In order to buy a foreign-made wind turbine, with ARRA stimulus money the Town of Falmouth had filed a waiver with the federal EPA. American Recovery and Reinvestment Act of 2009 (ARRA) funds can not be used if they create: "a substantial and specific danger to public health or safety related to the implementation or use of recovery funds"

AGENCY: Environmental Protection Agency (EPA). Effective Date: April 19, 2010.

1. EPA waiver admission: "Based upon information submitted by the Town of Falmouth and its consulting engineer, it has been determined that there are currently no domestic manufactured wind turbines available to meet its proposed project design and performance specifications."

Actuality -General Electric a domestic wind turbine company refused due to residential setbacks and ice throw to a nearby highway

2. EPA waiver admission: "The Town of Falmouth has adopted a local ordinance regulating large scale wind turbines. According to the submittal, Zoning Article XXXIV, Chapter 240, Section 240–166 requires a Special Permit for windmills with minimum setback from property lines."

Actuality -The Town of Falmouth never filed Special Permit 240-166.

3. EPA waiver admission: "The Town of Falmouth, in discussions with the EPA Regional Office, has stated that it will implement a mitigation plan to minimize any potential ice throws to ensure public safety, which appears to provide an ample margin of safety even within the domestic manufacturer’s internal siting considerations, where the setback distances meet Town zoning requirements, and any setback concerns appear relatively minor and appropriately mitigated."

Actuality: The Town of Falmouth was warned by email and in writing prior to construction by the foreign manufacturer of the wind turbine about the noise. The turbine by itself generates 110 decibels of noise twice as loud as the domestic wind turbine discussed with the EPA Regional Office. The town has a KEMA Inc study done 5 years earlier showing up to 200 residential homes would suffer wind turbine noise
