Are These Breast Cancer Awareness Bracelets Lewd?

Two girls are challenging their Pennsylvania school district's claim that their "I (heart) boobies!" bracelets, which promote breast cancer awareness, are lewd.

The U.S. Supreme Court may decide on whether a Pennsylvania school district should have suspendedΒ two students who wore "I (heart) boobies!"Β breast cancer awareness bracelets.Β 

The Easton Area School District in Pennsylvania suspendedΒ the girls in 2010Β because they woreΒ β€œI (heart) boobies!” bracelets. The school officials called the braceletsΒ "lewd."

The girls said they were merely trying to raise awareness at their middle school and appealed the decision. The 3rd U.S. Circuit Court of Appeals rejected the school district’s claim and the school district, in turn, voted to appeal that decision to the U.S. Supreme Court.

The AP reportedΒ that Superintendent John Reinhart told The Express-Times of Easton that the court β€œcomprised administrators' abilities to intervene in what is and what is not appropriate in school.”

Easton Area Solicitor John Freund said a number of national and state organizations are backing the district’s decision. HeΒ said schools officials are β€œconcerned about the implications of a hyper-sexualized environment,” reported Lehigh Valley Live.

Mary Catherine Roper, an attorney with the American Civil Liberties Union, which is assisting the girls in challenging the ruling, said, "I'm just really surprised that they're so determined to fight this speech case of all speech cases... (The bracelets) didn't cause any problems in the school."

The bracelets are distributed by the nonprofitΒ Keep A Breast Foundation of Carlsbad, CA.
