5 Things To Know As MA Mom Lindsay Clancy's Triple Murder Trial Continues Deliberations

Here are five things to know about the Lindsay Clancy triple murder trial as the jury deliberates for a fifth day.

1. The jury informed the judge Tuesday that they cannot reach a unanimous decision. The judge sent them back for further deliberations anyway.

2. In the event the jury claims a second time they cannot come to a unanimous decision, the judge can still send them back again.

"Two Massachusetts veteran criminal defense attorneys told The Post if jurors tell (Judge William) Sullivan again that they still can’t reach an agreement, the judge could give them a formal instruction called a 'Tuey-Rodriguez' charge, telling them again to try to reach an agreement, according to a New York Post story.

"Boston attorney Peter Elikann said the Tuey-Rodriguez charge is 'known colloquially as the dynamite charge … And it really pushes the jury and urges them to try to work out a unanimous decision," the Post story said.

3. If the jury is in fact unable to render a verdict, Lindsay Clancy, 36, can be tried again.

"If the jury remains deadlocked, the judge may eventually choose to declare a mistrial, ending the trial without a clear resolution and raising the possibility of another trial down the road," CNN reported.

4. On the other hand, prosecutors can choose not to try her again for killing her three children — 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan Clancy — which she has admitted to.

"But the state isn’t required to pursue a second trial, Zoltek-Jick said. It would be at the discretion of prosecutors to do so," according to Northeastern Global News.

5. In the event prosecutors do not pursue a second trial, the murder charges can remain pending until such time as they choose to, or they could dismiss the case.
