Lindsay Clancy Triple Murder Jury Again Deadlocked, Judge Reads 'Dynamite Charge': Reports

The Lindsay Clancy triple murder jury again said it was deadlocked, according to reports, but instead of declaring a mistrial, Judge William Sullivan read them the "dynamite charge."

"The judge sent the jury back for more deliberations after giving them a standard, legally required instruction intended to prod them to keep discussing a possible verdict," PBS reported.

Two Massachusetts criminal defense attorneys predicted that Sullivan would invoke the “Tuey-Rodriguez” charge in the event the jury claimed they were still unable to reach a verdict, according to a New York Post story.

"Boston attorney Peter Elikann said the Tuey-Rodriguez charge is 'known colloquially as the dynamite charge … And it really pushes the jury and urges them to try to work out a unanimous decision,'" the Post story said.

The Tuey-Rodriguez instructions "which were refined in and named for two Massachusetts Supreme Judicial Court cases, ask jurors on each side to rethink their position and "consider that it is desirable that the case be decided," a USA Today story said.

Clancy, 36, is charged with the January 2023 murders of 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan Clancy.

"Prosecutors have said that in January 2023, Clancy intentionally strangled the three children with fitness bands in their Massachusetts home before jumping out of a second-floor window," the BBC reported. "Clancy, now 36, was paralysed by the jump and has attended the trial in a wheelchair."

"Clancy's attorneys do not dispute that she killed the children," according to PBS. "But they say she should not be held criminally responsible because she was mentally ill, believing she heard voices ordering her to take their lives and her own."
