PLYMOUTH, MA — Lindsay Clancy was back in court Tuesday for the first time since a judge declared the Duxbury mom's triple murder case a mistrial.
Prosecutors requested a gag order after her defense attorney made comments about the lone holdout juror who wanted her found guilty, according to the New York Post.
"In order to prevent the carnival atmosphere that was the trial between July 21, 2026, and September 4, 2026, as well as the aftermath since, this court can and should limit the extrajudicial statements made in this case …" the Post quoted from a court papers.
Clancy, 36, is charged with the January 2023 murders of 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan Clancy.
"Prosecutors have said that in January 2023, Clancy intentionally strangled the three children with fitness bands in their Massachusetts home before jumping out of a second-floor window," the BBC reported. "Clancy, now 36, was paralysed by the jump and has attended the trial in a wheelchair."
"Clancy has admitted that she killed her children in 2023. However, her attorney, Kevin Reddington, claims her mental state was so impaired by postpartum mental illness that she shouldn't be held criminally responsible for their deaths," according to WBUR.
Judge William Sullivan declared a mistrial Sept. 4.
On Tuesday, Clancy's attorney Kevin Reddington argued that Judge William Sullivan should issue a required finding of not guilty, according to CBS.
"Reddington claimed that Clancy should be found not guilty because of 'the total and complete lack of evidence to indicate to a rational juror' that she was guilty," CBS reported.
