
With the Fourth of July here and many of us planning on seeing a fireworks show, either in Wilmington or elsewhere, it’s a good time to get an understanding about Massachusetts laws regarding the use of fireworks.
The relevant law regarding the sale, possession or use of fireworks in Massachusetts is M.G.L. c 148 § 39, which states:
No person shall sell, or keep or offer for sale, or have in his possession, or under his control, or use, or explode, or cause to explode, any combustible or explosive composition or substance, or any combination of such compositions or substances, or any other article, which was prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration, or detonation.

What are the penalties for violating the fireworks law?
Those who sell, keep for sale, or offer to sell any fireworks in violation of this law shall be punished by a fine of not less than $100.00 but no more than $1,000.00 or by imprisonment for not more than 1 year, or both.
Those who have in their possession or use fireworks in violation of this law shall be punished by a fine of not less than $10.00 dollars but no more than $100.00.
