Domestic Violence lawyer, Boria Gets a Not Guilty Jury Verdict for Innocent Man
Fenton man was charged with domestic violence out of the 52 District Court in Clarkston after a 911 call was made. Jury acquitted the man after only 7 minutes of deliberations.
Matthew was charged with Domestic Violence, a misdemeanor punishable by up to 93 days in jail, hefty fines, loss of his ability to possess a firearm, and other loss of other liberties.
Matthew was at his home in Fenton, Michigan with his former fiancé and roommate. The three of them had been at the bar where they all had dinner and drinks. When they got back to the home Matt and his fiancé began to argue and eventually the police were called.
When the police arrived the fiancé told them that Matt had choked her to the point that she began to lose consciousness. Matt tried to explain that he was only defending himself and that he did not choke her. Matt was arrested.

When we appeared at the 52-2 District Court in Clarkston, Michigan, the Oakland County Prosecutor’s office made an offer to Matt; if he plead guilty and completed a lengthy probation term the conviction would not be entered. Matt rejected the offer because he was not going to plead guilty to something he didn’t do, so we went to trial.
In trial the fiancé came clean and admitted that she was never choked. She had made it up because she was upset with him and wanted to get him in trouble. She also admitted that she had been violent toward him in the past.

The police officers testified that they did not observe any visible marks on the fiancé.
Matt took the stand and testified that she has assaulted him in the past and when she began to assault him on this occasion he stuck his hand out, without striking her, to stop her from hitting him.
The jury saw the truth and returned a verdict of Not Guilty of Domestic Violence after only 7 minute of deliberation.
