Kayla Montgomery Could Consider Potential Plea Agreement Offer Friday

MANCHESTER, NH — The stepmother of a girl killed in 2019 is expected to be offered a plea deal on several charges against her, which were discovered during the investigation of the girl’s death.

Kayla Montgomery was not in Hillsborough County Superior Court North on Wednesday for a dispositional hearing after failing to appear at a September hearing. She faces two perjury charges, accused of lying to a grand jury, as well as felony theft welfare fraud, for collecting benefits for months while Harmony Montgomery was not living with her, according to an indictment, and receiving stolen property-firearms, connected to a case against her husband, Adam Montgomery.

Outside the courtroom, Paul Garrity, Kayla Montgomery’s attorney, said there was “no deal” yet, but there could “potentially” be an offer from the state on Friday.

“She is of sound mind, and she’s contemplating which way to go with the case,” he said. “Any time a defendant enters a plea agreement, and enters a plea, it’s an indication they want to resolve the case.”

Rumors about a possible plea deal have been floating around since April, when the Boston Herald reported a deal was in the works. The deal, however, never materialized.

The charges against the couple were discovered during a multi-month investigation into Harmony Montgomery, a 5-year-old girl who was last seen in the fall of 2019.

Prosecutors accused Adam Montgomery of killing the girl by repeatedly punching her with his fists on Dec. 7, 2019, when the family was living out of a car in Manchester. He was arrested Monday.

Harmony Montgomery’s body has not been found but investigators have searched several locations for clues and evidence.

Adam Montgomery is due in Hillsborough County Superior Court North on Thursday for a pretrial hearing on receiving stolen property, two felon in possession, two handguns-armed career criminal, and three theft by unauthorized taking charges, all felonies, connected to a stolen gun investigation uncovered during the search for Harmony Montgomery. He was indicted on the charges in June. Adam Montgomery faces a mandatory minimum of 10 years in prison but not more than 40 years if convicted on each of the career criminal charges as well as fines and 11 to 22 years and fines on the theft and felon in possession charges.
