Father, Stepmother Of Missing NH Girl, Indicted On Stolen Gun Charges

A dispositional conference was held for Adam Montgomery Tuesday after he was indicted on stolen gun charges; Kayla Montgomery also indicted.

CONCORD, NH — The father of a missing New Hampshire girl was not in court on Tuesday for a dispositional conference hearing concerning several stolen gun charges.

Adam Montgomery’s attorney, Caroline Smith, as well as Jesse O’Neill, a prosecutor from the New Hampshire Attorney General’s Office, met in Hillsborough County Superior Court North to discuss how to move forward on a number of charges discovered as part of the investigating into locating Harmony Montgomery, 8, who has been missing since the fall of 2019.

The conference was held a week after Adam Montgomery, 32, was indicted on receiving stolen property, two armed career criminal, two felon in possession, and two theft by unauthorized taking or transfer charges, all felonies. He was accused of knowingly possessing a stolen rifle and shotgun in September and October 2019, after being convicted of four felonies in the past — criminal threatening in April 2008 and first-degree assault in January 2009 in New Hampshire and armed robbery in December 2009, and assault and battery with a dangerous weapon in March 2014 in Massachusetts.

Adam Montgomery faces a mandatory minimum of 10 years in prison but not more than 40 years if convicted on each of the career criminal charges as well as fines and 11 to 22 years and fines on the theft and felon in possession charges. He was not in court on Tuesday either in person or by video. Adam Montgomery also was indicted months ago on a felony second-degree assault charge as well as interference with custody and two endangering the welfare of a child charges after being accused of assaulting his daughter in July 2019. He is being held without bail.

Kayla Montgomery, 31, was indicted on June 21 on a receiving stolen property charge after being accused of retaining a stolen shotgun during the same time period. She faces seven and a half to 15 years in prison as well as a $4,000 fine if convicted. Kayla Montgomery is also facing perjury and welfare fraud-theft charges. It was previously reported her attorney might be lining up a plea deal on the theft charges but that has not been confirmed. She is currently out on bail.

Investigators have stated the charges were not connected to the Harmony Montgomery missing child case but were discovered during the course of the investigation for the missing girl.

On Oct. 27, a status conference will be held concerning the assault case against Adam Montgomery. A pre-trial hearing will be held the same day on the stolen gun charges. Jury selection will begin on the stolen gun charges on Nov. 7.

No future court dates have been scheduled for Kayla Montgomery and her cases.

The court hearing comes two weeks after federal and state investigators spent a number of hours searching an apartment complex on Union Street in Manchester where the couple previously resided.

Harmony Montgomery, who was 5 when she was last seen, is white, about 4 feet tall, and weighs around 50 pounds. She has blonde hair, blue eyes, and should be wearing glasses. Harmony Montgomery is also blind in one eye.
