The two were separated and Delrosario reportedly told one of the officers that his mother “wanted him to get help at the hospital but he didn’t want to,” according to the report. He allegedly smelled like alcohol, his eyes were red and glossy, and he could barely keep them open. When asked if he had been drinking, Delrosario allegedly stated, “No.”

Delrosario reportedly told the officer that he had been staying at a local shelter but was no longer staying there. He called his mother for a ride, hoping she would let him come back home, but when she drove him to the hospital, he refused to go in and started walking away, he reportedly told the officer.

“I asked Tabauhris where he was heading and he told me his friend’s house on North Main Street, but didn’t know the address,” the officer alleged.

The officer then spoke with the mother who stated she would only give him a ride to the hospital and Delrosario allegedly agreed. She then went to pick up her boyfriend, Petruccelli, and then picked up Delrosario. They then took him to the hospital but when they arrived, they started arguing and Delrosario allegedly walked away.

Petruccelli reportedly left the area but a check revealed the warrant out of Derry. Officers caught up with him later in the emergency room parking lot and he was arrested and held until a Derry officer could pick him up.

The reporting officer returned to Delrosario, who was allegedly “swaying back and forth while standing still,” and asked him to take a portable breath test and he said, “No.” After some discussion with all involved, he was arrested for internal possession of alcohol. After being cuffed, police allegedly found two 187 ml bottles of Sutter Home Chardonnay in his jacket pockets.

Delrosario is due in court on Aug. 3.

According to online reports, Delrosario has had previous encounters with police, including a simple assault charge in November 2013 in Hampton, according to Seacoastonline.com, and a shoplifting charge in Seabrook in November 2014, according to the Newburyport News.

Petruccelli has also had some run-ins with the law, according to online reports.

In July 2011, he was arrested for giving a false report to law enforcement in Rochester, according to Foster Daily Democrat, after a disturbance at a residence. He was later arraigned in Dover District Court on the charge. In June 2012, according to Portsmouth NH Patch, he was arrested on a bench warrant for being a fugitive from justice on Borthwick Avenue in Portsmouth.
