ARRESTS: Concord Man Faces Multiple DWI Charges

The following information was supplied by the Concord Police Department. It does not indicate a conviction.

  • John Niesse, 50, of Concord, was arrested at 9:18 p.m. on Dec. 14, 2012, two counts of driving while intoxicated, and single counts of driving while intoxicated second offense and aggravated driving while intoxicated. According to an arrest report, an officer was dispatched to the Applebee’s for a two-car accident, with one person who was allegedly intoxicated and out of his vehicle, stumbling around. The officer wrote that as he approached Niesse, “he was swaying heavily” and said he couldn’t stand in one place. Niesse allegedly told the officer he was at Newick’s earlier in the evening. “He had a strong odor of alcohol coming from his mouth,” the officer reported. The officer noted blood on his forehead so he called to have Concord Fire and Rescue teams come and clean him up. Niesse’s speech was allegedly slurred and his eyes were allegedly bloodshot and glassy so he was given a field sobriety test. He was later arrested.
  • Melissa Philibert, 31, of Manchester, was arrested at 2:45 p.m. on Dec. 21, 2012, on a simple assault (personal weapons) charge. According to an arrest report, an officer was called to East Side Drive for a domestic disturbance. Upon arrival, the reporting officer saw that another officer had arrived at the scene and was separating the parties involved in the call. A man at the scene allegedly told the other officer that he was arguing with his girlfriend, Philibert, and “that during the argument she punched him in the area of the left side of his head.” The officer reported not seeing any marks, redness, or swelling on the man’s head. The man alleged the Philibert had done harm to herself as well. The reporting officer went to the apartment and spoke to Philibert who was allegedly crying and holding a pair of scissors. The officer told her to put down the scissors and she reportedly did. Philibert allegedly told the officer that during the argument with her boyfriend, “he was calling her names.” Concord Fire and Rescue teams arrived and assisted Philibert with a bandage. After that, she was arrested. Philibert was released on $2,000 personal recognizance bail and is due in court on Jan. 28.
  • Tiffany Elizabeth Proulx, 31, of Concord, was arrested at 2:30 a.m. on Dec. 27, 2012, on a simple assault (personal weapons) charge. According to an arrest report, officers were called to Beacon Street for a domestic disturbance. Dispatch reportedly told the officers that the caller could hear a man telling a woman to stop hitting him. Upon arrival, officers reported hearing a woman’s voice in the apartment, “her voice was raised and aggravated,” according to the report. As the officers knocked on the apartment door, no one answered at first. Later, Proulx reportedly answered the door. The report noted that she appeared to be upset and explained that the argument had to do with issues relating to her daughter at Christmas. Proulx denied getting physical with her boyfriend. However, while interviewing the boyfriend, an officer reported seeing “three small bumps on the left side of (his) forehead” which appeared to have been caused by knuckles, according to the officer. When asked if the bumps on his head were from that evening, the man reportedly confirmed they were. When asked how the bumps got there, the boyfriend allegedly shrugged his shoulders. Proulx allegedly denied again that she struck her boyfriend but later allegedly admitted she had hit him. She was arrested and later released on $2,000 personal recognizance bail. Proulx will be arraigned on Jan. 28.
  • Diane Mary Delaney, 61, of Contoocook, was arrested at 5:27 a.m. on Dec. 27, 2012, and charged with simple assault (personal weapons) and criminal mischief (vandalism). According to an arrest report, an officer was called to an apartment at South Street for a domestic disturbance, between a man and woman screaming at each other, “with a lot of banging going on” from the apartment. Another officer arrived and the two spoke to the parties involved. According to Delaney, her and her ex-husband had a verbal altercation. An officer noted a guitar that appeared to be smashed in the living room. Delaney allegedly denied having anything to do with the guitar, saying it was damaged previously, and denied that the argument was physical. The officer noted that there were “miscellaneous items scattered around the apartment floor.” The other officer reported that the ex-husband was wearing a white T-shirt that had a stretched out neck and stretches in the shirt that appeared to be hand marks. The man also had scratches on his chest. Sometime during the argument, the man alleged, Delaney “stomped on the guitar breaking it,” according to the officer. The guitar was sentimental to him, since it was very old. Delaney was arrested and later released on $2,000 personal recognizance bail. The man declined to provide a written statement in the case.
  • Jean Volf, 37, of Concord, was arrested at 12:40 p.m. on Dec. 27, on a simple assault (personal weapons) charge. According to an arrest report, officers were called to Cabernet Drive for a domestic disturbance. A man was reportedly standing in the driveway of the home, later identified as Volf. Volf was asked to move into the garage while another officer went into the home to speak to a woman inside. Volf reportedly told the officer that he had gotten angry with his girlfriend after an appointment outside of the home. After they both returned home, Volf allegedly turned off all the phones in the house. His girlfriend reportedly plugged a phone back in and Volf allegedly grabbed her and pushed her out of the way. The other officer spoke to the woman who alleged that Volf had hit her after demanding she get off the phone while she was on a call. A scuffle ensued and Volf allegedly pushed the woman out of the way. Later, he grabbed her again and allegedly struck her on the side of the head. She later allegedly struck Volf with the phone in an effort to get away. The officer reported seeing a bloody lip. Another witness in the home confirmed what the woman stated, according to the report. Volf was arrested but the woman reportedly declined to give a written statement, complete a threat assessment report, or allow pictures to be taken of her wounds. Volf was released on $2,000 personal recognizance bail and has a court date on Jan. 28.
