ARRESTS: Penacook Teen Charged on Two Threats Counts

The following information was supplied by the Concord Police Department. It does not indicate a conviction.

  • Ricky Franco, 35, of Concord, was arrested at 12:33 p.m. on Sept. 21, on a default or breach of bail conditions. Officers were called to South State Street for a report that Franco, who had previously been arrested on a simple assault charge and was not allowed to be at the address, was violating bail. A woman at the address alleged that Franco had walked into her apartment and left just before she called police. There was no one at the apartment when officers arrived but later, the complainant came back to the apartment and spoke with police. She alleged that Franco woke her and her roommate up around 5 a.m. and wanted to talk about his arrest, since he had no place else to go. The woman told him to leave but he alleged refused and accused her of leaving him homeless. When asked why she didn’t call before he left, the woman alleged, “If I call the cops in front of him I’ll get a beating.” Both women said they didn’t know how he got in and said the door was locked and he didn’t have a key to the apartment. The officer confirmed the no contact order on the bail and then went looking for Franco, including at a Myrtle Street home. Franco wasn’t there, but the officer reported seeing him later walking on North State Street. During questioning, Franco allegedly denied being on South State Street but later, the officer reported, he changed his story and was arrested. He refused bail and was arraigned on Sept. 23.
  • Cynthia D. Saxon Hoffman, 49, of Concord, was arrested at 2:22 a.m. on Oct. 5, on possession of controlled drugs and resisting arrest or detention. Officers were called to Concord Hospital on Pleasant Street for a person in need of protective custody. The person, Saxon Hoffman, was allegedly agitated, loud and vulgar, and refused to put her clothes on. “Hospital staff was eventually able to get Saxon Hoffman clothed,” the officer noted. Saxon Hoffman, the officer alleged, reeked of alcohol and was “seated and swaying from side to side.” The officer later learned that she allegedly had a 0.226 BrAC test, according to a court document. The officer took Saxon Hoffman into custody while she was allegedly screaming the entire time. While walking her out, Saxon Hoffman allegedly screamed, “get your f---ing hands off me,” and allegedly “swung her head back towards” the officer who had to duck to keep from being hit. “While doing this, Saxon Hoffman lunged forward and began moving from side to side, trying to free herself from my grasp,” the officer alleged. She was later transported directly to the Merrimack County House of Corrections. During an inventory, a pipe, with charred marijuana, was allegedly found in her purse. Saxon Hoffman was arraigned on Oct. 7.
  • Michael Leo Murphy, 17, of Pittsfield, was arrested at 4:15 p.m. on Oct. 9, and charged with suspended registration (operating-misd) and driving after revocation or suspension. While driving on Pleasant Street, an officer observed a 2002 Ford Taurus cross the white fog line and slowly drift back in to the travel lane at least two times. The vehicle was later stopped at Warren and West Washington Street. The driver stated that it was the tire on the vehicle that was having a problem. There was a young woman and a baby in the car with the driver. When asked for his registration and license, the driver, Murphy, said he didn’t have them because they were suspended. Later, the officer confirmed that Murphy’s license was suspended on Aug. 29, and he was arrested. Murphy later allegedly stated that he knew he shouldn’t be driving but had no other way to get home from Concord Hospital. He was released on $500 personal recognizance bail and is due in court on Nov. 25.
  • Dylan Christopher Butler, 17, of Penacook, was arrested at 1:52 p.m. on Oct. 10, on two counts of criminal threatening (intimidation, etc.), and default or breach of bail conditions. The charges stem from alleged incidents in June on South State Street. After clearing a call on Washington Street in Penacook, an officer was flagged down and told that Butler was at a home on Village Street and there was an active warrant for his arrest. The officer checked the claim and found the warrants from Sept. 19. The officer went to Village Street and found Butler who allegedly told the officer he knew about the warrant but didn’t turn himself in because he didn’t have bail money. He was arrested and later, released on $10,000 personal recognizance bail. Butler’s due in court on Nov. 25.
  • Kirsten Lee Porter, 20, of Concord, was arrested at 7:53 p.m. on Oct. 11, on a bench warrant. While on bike patrol on Chapel Street near North State Street, an officer observed two individuals and realized one, Porter, had a warrant. A warrant check was requested and it came back from a theft by unauthorized taking or transfer charge from Concord District Court. Other officers arrived at the scene and Porter was taken into custody. She was released later on $1,000 personal recognizance bail and is due in court on Nov. 25.
  • Blake C. Patria, 29, of Concord, was arrested at 2:46 a.m. on Oct. 13, on a simple assault (personal weapons) charge.
  • Rebecca Ceriello, of Concord, was arrested at 2:46 a.m. on Oct. 13, on a simple assault (personal weapons) charge. Officers were called to a domestic dispute between a couple at an apartment on North State Street. Ceriello answered the door and the officer noted that she was visibly upset and had scratches on her arms. However, she denied anything happened, just some arguing. The officers split up with one staying with Ceriello and another entering the apartment to speak to the man, later identified as Patria, who had a large scratch across his neck. Patria was also bleeding from his right side, near his hip, and the officer reported seeing blood on bed sheets. Patria repeatedly allegedly denied that anything happened. The officers noted that both individuals appeared to have been drinking that evening. The officer then went back out to speak to Ceriello who reportedly stated that the argument became heated and elevated, with both of them pushing each other. The officer went back to speak to Patria who allegedly wouldn’t confirm who started the fighting. When the officer said that someone was going to be arrested due to the incident, Patria allegedly said he should be arrested since Ceriello had a job to go to in the morning. However, later, the officers determined that both should be arrested and they were. Both were released on personal recognizance bail and are due in court in November. Patria was advised not to return to the apartment until the matter could be settled in court and not to have contact with Ceriello.
  • Donald Duddy, 63, of Concord, was arrested at 3:04 p.m. on Oct. 14, on a warrant. Officers were called to the Morning Star Apartments on Loudon Road to transport Duddy on a warrant out of Carroll County for failure to appear for distribution of obscene material from Aug. 31, 2012. Duddy was taken to the Tilton Police Department and given to a sheriff’s deputy.
  • Jason P. Marcoux, 37, a homeless man now located in Concord, was arrested at 11:33 a.m. on Oct. 15, on two thefts by unauthorized taking or transfer charges. An officer was called to the New Hampshire Liquor and Wine Outlet on Storrs Street for a report of a man stealing a 1.75 liter bottle of Jack Daniels, valued at about $41. The officer watched surveillance video and saw the man allegedly conceal it in his clothing and leave the store. A store employee noted that the same person may have been in the store a few days before stealing items. Another officer showed up to the scene and the two began to canvas the area looking for the man in the video. They later came across Marcoux who was in the rear of the liquor warehouse. “I asked where the bottle of Jack Daniels came from and Marcoux pretended to have no knowledge of where the bottle came from,” the officer alleged. Marcoux was arrested and later, released on $3,000 personal recognizance bail. He’s due in court on Nov. 25.
  • William George Ellis, 35, of Concord, was arrested at 8:45 a.m. on Oct. 16, and charged with driving after revocation or suspension and a bench warrant. While on motorcycle patrol on North Main Street, an officer observed a vehicle drive through a red light. The vehicle was pulled over on Commercial Street. After getting Ellis’ information, a warrant was found out of Sixth District Circuit Court from Jan. 23, on a theft charge for nonpayment of attorney fees, $302.50 cash to settle. Previously, Ellis was convicted of operating after suspension on May 7, 2007, according to the report. He was arrested and later, released on $2,000 personal recognizance bail. Ellis was arraigned on Oct. 28.
  • Samuel C. Vachon, 21, of Concord, was arrested at 5:57 p.m. on Oct. 18, and charged with theft, attempted theft by deception, and a bench warrant. An officer was called to Loudon to meet Laconia Police who had Vachon in custody in connection with alleged incidents at Walmart on Loudon Road on Sept. 30, involving a Keurig coffeemaker valued at $169. Vachon was picked up on an active capias from Belknap County for disobeying an officer, possession of drugs, and failure to obey police with a court date set for Dec. 5. Vachon was released later on personal recognizance bail with future court dates.
