Concord Man Arrested for Assaulting Cop

Dustin Averill arrested by police on numerous charges.

A local man with a string of arrests was arrested last month after a domestic disturbance on Fisherville Road.

Dustin P. Averill, 20, a homeless man now located in Concord, was arrested at 8:25 a.m. on Dec. 25, 2014, and charged with simple assault, resisting arrest or detention, and unlawful possession of alcohol.

According to an arrest report and court affidavit, an officer was sent to Fisherville Road for a disturbance between a man and woman screaming at each other and banging on the walls, with an upstairs neighbor suspecting that there were holes being punched into the walls.

The officer arrived at the north side of the building when he saw Averill exit the building while reportedly carrying a 25-ounce can of High Gravity Beer.

“Averill quickly turned around and ran back into the building,” according to the report, with the officer running in after him.

The officer yelled at him to stop, which he did. He wouldn’t, however, answer any questions and “had a blank look in his face.” While being questioned, Averill allegedly jumped up and ran down the hallway and the officer grabbed at his shirt but he kept running. The officer grabbed his upper body and demanded that he stop fleeing but Averill allegedly wouldn’t obey the command.

“Averill grabbed my arm and shirt and he tried to forcefully slam me into the wall and break my grip,” the officer alleged. “I had a hold of him and I pinned him up against the opposite wall.”

Averill allegedly continued to struggled and pushed back at the officer, grabbing at the officer’s radio microphone. The officer pulled him backwards, took him down to the ground, and attempted to cuff him. Averill, however, reportedly continued to struggle and fight, causing the officer to scrape his knees on the ground during the scuffle.

Averill allegedly started screaming at the officer but later calmed down and reportedly told the officer that he ran because he panicked. During a pat down, the officer allegedly found a box cutter and a cap to a syringe.

He was arrested and held on $3,000 cash bail.

In the past, Averill has been arrested for rioting and assault in December 2011, that was connected to a stabbing incident. He was also arrested for theft in July 2014, after an incident at Walmart on Loudon Road in May. In May 2014, he was picked up on a bench warrant after allegedly shooting up heroin in the McDonald’s Restaurant on Loudon Road.
