Concord Man Arrested Twice in 27 Hours

Arthur Foss was first charged with domestic assault and criminal mischief. The next day, it was a breach of bail charge.

A local man was scheduled to be arraigned this week on domestic violence charges after being arrested twice in the same week last month.

Arthur A. Foss, 31, of Fisherville Road in Concord, was first arrested at 5:15 p.m. on Feb. 9, 2015, and charged with domestic violence-simple assault, simple assault, and criminal mischief. The next day, he was arrested at 8:15 p.m. on a default or breach of bail conditions charge and held, according to police reports.

Officers were sent to an apartment of Fisherville Road for a domestic disturbance around 4:45 p.m. on Feb. 9, according to a report.

When they arrived, they spoke to a man outside of the residence who pointed to the door of the apartment and said, “They’re inside, they just got into an argument.” The officer reported seeing fresh blood smeared on the outside of the door and then spoke to a man and asked who was bleeding. The man then pointed to the middle bedroom.

The officer then spoke to a woman and asked if she was bleeding and she stated that she was not but her husband was. She alleged that her husband had broken a picture frame during the course of the argument. The officer reported that the bedroom was “extremely messy and cluttered,” and glass and blood were on a frame in the trash. The officer noted that the woman’s neck appeared red and flush but she stated, “Oh, that’s nothing,” and denied that an assault took place.

Meanwhile, according to the report, Foss was taking a shower and came out to speak with officers. The reporting officer noted that he was bleeding from his hands but refused assistance from fire and rescue teams.

Foss reportedly told police that he was just out of jail and on probation and had found out unsettling, personal news from his wife and was angry about it. When asked what happened to the picture frame, he allegedly stated, “I punched it … because I’m f----- p----- at her.” He reportedly denied touching his wife in anger though.

“I then noticed that Arthur had many scratches and cuts on the right side of his neck and on his left wrist,” the office noted. “I then asked Arthur what the scratches and cuts were from. Arthur said, ‘They’re all self-inflicted. I did those to myself.’”

However, another officer, after speaking to witnesses, reported that Foss had allegedly had the woman up against a wall and put his hands around her neck, according to the report. The witness intervened as the incident escalated.

Foss was arrested and allegedly became “hostile” and started “running his mouth and swearing,” but was told by others in the apartment to calm down. He was later released on personal recognizance bail.

The next day, officers were again called to the apartment, after they were tipped off by a family member that Foss was at the apartment in violation of his bail. They were allowed into the building just as Foss was allegedly trying to flee.

Foss later claimed that his wife showed up at the apartment and he “did nothing wrong” but the court paperwork stated that he was not to be within 300 feet of the victim, according to the report. Foss was arrested and held without bail.

According to online reports, Foss was arrested in Tilton in December 2013, for simple assault.
