Concord Man Faces Handgun Threat And Criminal Trespass Charges

CONCORD, NH — A man from Concord is facing deadly weapon and trespass charges after an incident in April.

Around 11:30 a.m. on April 6, officers were sent to Chenell Drive for a report of a criminal threatening incident. Dispatch, before police arrived, said one man was accusing another of pointing a handgun at him. The man then drove away in a pickup truck.

The reporting officer spoke to the complainant and two witnesses. The complainant, a business owner, said he and the other witnesses were speaking when David Whitcher, 61, of Penwood Drive in Concord, drove into the parking lot and stopped near him, a report said. The owner said he knew Whitcher from a previous incident in 2014, the officer wrote.

“(The owner) informed me that David drove slowly through the parking lot and stopped in front of (his) vehicle,” the reporting officer wrote, noting Whitcher’s actions made it so he could not move his truck out of the space.

One of the witnesses approached Whitcher, told him he was not supposed to be on the property, and asked him to leave, a report said. But Whitcher refused, the affidavit said.

The owner also told Whitcher to leave and accused him of replying, What are you going to do if I don’t? The owner countered he would pull him out of his vehicle and “beat his ass,” the report said. The owner then accused Whitcher of reaching down, pulling out a handgun, pointing it in a forward direction, and stating, “I will drop you where you stand.”

Whitcher then drove off, the affidavit said.

The other two witnesses were questioned by the reporting officer and confirmed the flashing of the handgun and the statement, according to the affidavit.

Whitcher was stopped by officers on North Main Street about 10 minutes later and was accused of having a .40 caliber handgun in the truck. When questioned, he said he went to visit his nephew on Chenell Drive, an affidavit stated. Whitcher was released from the scene, and later, a warrant was issued against him.

The business owner was asked about the nephew and said Whitcher did not have a nephew or any other relative that worked on Chenell Drive, the report said.

Whitcher was arraigned in Merrimack County Superior Court on June 30.
