As the officer was fixing the barricades, he saw several males skateboarding down Warren Street toward the barricades. Several turned into the parking area before the garage while one continued to his location.
The officer yelled at the man heading toward him – “at the top of my lungs” – to get off the board but the man reportedly continued to ride toward the officer. When the male passed the barricades, heading toward North Main Street, the officer stopped him by putting his hand up and onto the boarder’s chest, according to the report.
“Get off me, man,” the skateboarder, later identified as Loos, reportedly yelled while removing his earbuds.
The officer reportedly told Loos that he was violating the city ordinance by skateboarding and he allegedly replied, “What the f--- are you talking about? I’m leaving.”
As Loos walked away, the officer ordered him to stop but he refused, according to the report. The officer then grabbed Loos and ordered him to sit on the curb but he allegedly pulled away and refused to sit down. After he was warned that he would be arrested for resisting if he continued to pull away, Loos continued to demand to be left alone and stated he wanted to go, according to the affidavit.
The other skateboarders reportedly arrived at the scene and told Loos to “do the right thing,” “be smart,” and “listen,” while the officer confiscated his skateboard and requested that he sit down.
“The male continued to be argumentative, disrespectful, and uncooperative,” the officer alleged. “At one point, the male came towards me and got right in my face. When the male got within inches of my face, I detected the odor of an alcoholic beverage on his breath.”
The officer alleged that Loos was “very repetitive” and “wasn’t making much sense as he spoke” but began to back away from him and later, reportedly fled. The officer followed and demanded that he stop or he would be Tased, but Loos continued to flee, according to the court affidavit.
Loos reportedly ran through the alley, past the Capital Plaza, and then over to School Street. The officer caught up with him there, Tased him, and Loos reportedly fell forward face first onto the pavement.
Loos was cuffed while backup arrived and dispatch reported that he had an active warrant for nonappearance in court with $1,000 cash bail and he was arrested. Loos later allegedly admitted to another officer that he was “drunk, but not that drunk,” according to the affidavit. He refused bail and was arraigned the next day.
