Homeless Felon Faces Stolen Firearm, Fentanyl Sale, LSD, Crack, Other Charges In Concord

CONCORD, NH — A homeless felon, previously of Raymond, who has been in Concord recently, was arrested last month on several charges, including seven felonies accusing him of drug dealing and possessing a gun.

Around 10:15 p.m. on Sept. 25, 2022, an officer was patrolling Fisherville around Cumberland Farms, not far from the 7-Eleven, where a robbery had taken place the week before and was known for drug activity. While on patrol, the officer noticed a car at the gas pump for an extended period of time. The officer estimated it was parked at the pump about half an hour while driving by multiple times. The officer said no one appeared to be purchasing gas for the car, but he did see and man and woman exiting the vehicle.

The officer decided to stop and investigate what was going on and, while approaching the car, “saw, in plain view, a clear plastic bag containing a tan powdery substance protruding out of the driver’s left sweatshirt pocket,” a report stated. The officer, believing it was fentanyl, opened the driver’s door and removed the bag from the man’s pocket, an affidavit said.

Backup was requested, and that officer immediately recognized the man to be Cyle Reece Gancarz, 25. A passenger was identified as Ashley Marie Brickley, also 25, who was previously arrested in Concord on drug possession and other charges.

Gancarz was immediately arrested, and during a pat down, the officer accused him of possessing a clear plastic bag containing a white rock-like substance, believed to be cocaine, in his pants. When asked, Gancarz was accused of admitting it was crack cocaine. The officer also claimed he possessed a cigarette package that had a glass pipe with burnt residue on it, the report said.

The second officer asked Brickley about a backpack on the floor of the driver’s seat, and she said it belonged to Gancarz, according to the affidavit.

Later, the reporting officer weighed the baggie believed to be fentanyl, and found it to be around 12 grams.

The car, a Ford Focus, owned by Brickley, was towed, and a search warrant was requested.

According to the affidavit, inside the backpack were 14 packages of buprenorphine film, a tin foil with stamps consistent with LSD, another glass pipe believed to be used for smoking crack cocaine, two clear baggies of crack, two capsules with tan powder, three pills identified later as amphetamine and dextroamphetamine, five pills identified as cyclobenzaprine hydrochloride, two lorazepam bills, and a baggie of an unknown yellow substance.

Also inside the bag was a sock with 10 9 mm Ruger rounds, a red and white tube New Hampshire State Police identified as a marine flare, a golf ball-sized clump of a substance believed to be fentanyl, and two other baggies of fentanyl about the size of marbles, an affidavit said.

The officer also said Gancarz’s birth certificate and Verizon documents in his name were found as well as metallic knuckles, the report said, which connected the backpack to him.

In another compartment of the bag, the report said, a 9 mm Sig Sauer handgun with a Surefire light mount installed on it.

“The handgun was loaded with a magazine,” the officer wrote. “The magazine contained 10 9-millimeter Ruger rounds of ammunition. Dispatch was provided the gun’s serial number. I learned the handgun was reported stolen out of Manchester.”

Three more rounds were found in the bag, the report said.

The affidavit stated a pink duffel bag in the trunk of the car had $692 all in one-dollar bills. Another $20 was found in the center console. A tan purse, found on the passenger seat, with a bank card in Brickley’s name, had two Ziploc bags of a tan substance consistent with fentanyl, the affidavit stated. It also had $18 inside, too.

Brickley has yet to be charged in the case.

Gancarz was charged with one count of deal-possess prescription drugs, two felony drug possession counts, two felony drug sale counts, and two felon in possession of dangerous weapon counts, all felonies, and a possession of three-quarters of an ounce of less of marijuana.

A warrant for his arrest was issued on Nov. 28, 2022, and he was arrested on Jan. 19.

Gancarz was in Merrimack County Superior Court for a dispositional conference hearing on Thursday.

Gancarz, according to superior court records, is a felon due to a controlled drug act; acts prohibited felony conviction in March 2019, after an incident in September 2018 in Concord. In that case, he was also found to violate probation or parole six months later.

Gancarz was arrested again on more controlled drug charges in Concord in April 2019, and pleaded guilty to one of the charges eight months later. In between, he was accused of two more acts prohibited charges in July 2019, after an incident in Hooksett, but those charges were nolle prossed two months later.

Gancarz was arrested on more drug charges in Concord in September 2022. That case is still active, with an evidentiary hearing set for Feb. 15, and a dispositional conference hearing booked for March 30. Gancarz is also due in Hillsborough County Superior Court North for an arraignment on an unknown charge on Feb. 24.
