Homeless Sex Offender Arrested
Concord Police arrest Robert Clark twice in three days on various charges.

A local sex offender was arrested in March and April on three different charges, according to arrest reports.
Robert W. Clark, 26, a homeless man now located in Concord, was arrested at 2:15 p.m. on March 30, 2015, and charged with possession of controlled drugs. On April 1, at 7:53 p.m., he was arrested again and charged with duty to report and default or breach of bail conditions.
In the March 30 situation, Clark reported to police headquarters to register as a sex offender, from a previous child pornography offense from April 2009, against a victim under 16.

Clark came into police headquarters, according to a court affidavit, of his own volition. But the reporting officer also had a pending warrant for him from a previous incident on March 20, at the intersection of Washington Street at North Main, for allegedly being in possession of marijuana and a pipe. At the time of the incident, Clark was reportedly taken into protective custody and not charged. A warrant was later filed.
“When I explained the charge to Clark, he did not remember when I took him into protective custody,” the officer reported. “He stated that he is not going to disagree with that, when I told him he was being charged with possession of marijuana.”

Clark allegedly told the officer that he mainly used his pipe for tobacco but “he does occasionally smoke marijuana.” He was released on personal recognizance bail and was scheduled to be arraigned on May 4.
The reporting officer later realized that Clark appeared to be non-compliant with the registration process. Since he was a Tier II sex offender, he was required to register twice a year within five days of his birthday and six months later, meaning mid-September and mid-March, at the latest. When he came in, he was about two weeks late.
When asked about it, Clark allegedly stated that he thought he had the full month to register, according to the affidavit. While Clark had been registering with police since 2010, he was convicted of a previous duty to report charge in February 2013, so a warrant was taken out for his arrest again.
Two days later, two officers went to a homeless camp off Black Hill Road at the old drive-in theatre off Manchester Street attempting to find Clark. They found him in a tent and placed him under arrest.
The reporting officer noted that Clark allegedly smelled like alcohol and asked him if he had anything to drink that evening. He reportedly stated that he had a couple of 25-ounce Natty Daddy beers. Clark, according to the report, claimed he was sober, but the officer disagreed and alleged he had red, glassy eyes. Since he was out on bail, the breach charge was added. He refused bail, was held, and was arraigned the next day.
Previously, Clark has been convicted of theft and other charges, according to online reports.
