Homeless Woman Charged with DWI
Concord Police arrest Krystal O'Brien after she allegedly admitted to using heroin in the parking lot of the South Main Street McDonald's.

A New Hampshire woman was arrested last month for DWI after an incident at McDonald’s Restaurant on South Main Street, according to a court affidavit.
Krystal R. O’Brien, 24, a homeless woman now located in Lincoln, was arrested at 2:05 p.m. on July 19, 2015, on a driving while intoxicated charge.

Officers were sent to the McDonald’s Restaurant on South Main Street for a suspicious person sitting in a vehicle that appeared to be impaired. The caller stated that she was asked to move along but had not done so.
The officers spoke to the woman, later identified as O’Brien, who was sitting inside a Mercury Sable which had the keys in the ignition. One of the officers reportedly saw a plastic Cumberland Farms container in the cup holder with a syringe inside of the cup.

“I spoke with the subject who appeared to be very lethargic,” the officer alleged. “Her speech was mumbled and she was difficult to understand.”
When asked if she had used heroin that day, she alleged denied that she had and added that she had not used in a long time. The officer though reportedly noticed fresh track marks on her left hand and dried blood on her wrist. When asked about the syringe, she reportedly stated a guy she gave a ride to might own it. She allegedly tried to clean up the area but was told to stop. O’Brien later allegedly admitted to taking heroin the night before and earlier in the day, according to a court affidavit.
O’Brien was asked to get out of the car and sit in the cruiser where it was air conditioned while a field test kit was brought to the scene. She reportedly agreed but allegedly had a difficult time getting out of the car and stumbled three times and almost fell while walking to the cruiser. She later nodded off in the cruiser, the officer alleged.
The test on the syringe came back negative for heroin but due to her alleged “obvious physical impairment,” she was taken into protective custody and charged with DWI.
O’Brien was arrested and held without bail.
