When they arrived, they found the pickup truck owned by a Hopkinton female illegally parked but not running. The officer spoke to Fifolt who reportedly stated that he had been in an argument with his girlfriend and she walked away. The sergeant caught up with the woman and asked her to return, which she did.
“Nothing happened,” Fifolt allegedly stated to the officer as he tried to figure out what was going on.

The officer reported that Fifolt stated that he had been working in Pittsfield earlier when he came to Concord to get a haircut.
“When I first made contact with Fifolt, he was very animated,” the officer alleged. “Fifolt could not stand still and was pacing back and forth. As I was speaking with Fifolt I also detected an obvious odor of an alcoholic beverage on his breath. Fifolt was extremely unsteady on his feet and was having trouble forming complete sentences. I also noticed Fifolt's eyes were red, glassy, and slightly bloodshot.”
When asked who was driving the truck, Fifolt allegedly stated his girlfriend was. When asked if the incident was physical, he reportedly denied it. The officer then asked about reports that he was allegedly restraining the female and then, checked his driving status and found out that he had a suspended license. He was also convicted of DWI-third offense in Concord District Court in September 2015, according to the report.
The witness to the incident showed up at the scene and spoke to the sergeant and officer. The witness alleged that the man and woman were arguing, she exited the vehicle, then returned, while they continued to argue. She then tried to leave and he allegedly grabbed her arm, attempting to prevent her from exiting the truck.
“After several attempts, (she) was able to escape and exit from the vehicle a second time,” according to the report.
The woman, according to the report, said the fight was over Fifolt getting a haircut, while he was driving to different parts of the parking lot and they were arguing. She then left and then, “against her better judgment,” she reportedly told the officer, returned to the pickup truck. Then, she had had enough and left, according to the report. That’s when Fifolt allegedly grabbed her arm and tried to stop her from leaving, she reportedly stated. The woman also alleged that he had been driving and had been drinking beforehand. The officer noted that there were Natty Daddy and Natural Light beers, including an open container, inside of the pickup truck.
The officer returned to Fifolt and he allegedly admitted that he was driving while having a suspended license but denied the assault and imprisonment allegations.
“Fifolt became increasingly argumentative, hostile, and uncooperative,” the officer alleged, so he was arrested.
During the drive to headquarters, the officer alleged that he was “overwhelmed” by the odor of alcohol inside the cruiser. During processing, Fifolt was “extremely argumentative, uncooperative, and at some points during the process, unruly,” the officer alleged.
Editor's Note: This report has been edited to correct that the victim in the case was a woman.
