Lost Pool Game Leads to Second-Degree Felony Assault Charge
Second man reportedly sent to the hospital.

A friendly pool game at the Beijing & Tokyo recently turned sour after a former New Hampshire State Prison inmate allegedly punched another man after losing the game.
Donald Miller, 43, of Concord, was arrested on a second-degree assault charge, a felony, on March 2, but wasn’t arrested until the middle of May.
According to an affidavit report from the Sixth Circuit District Division Court, police took the statement of a man in the lobby of the police station who had allegedly been punched in the face by another man, later identified as Miller.

Concord Fire and Rescue teams treated the man, who had a swollen shut left eye, and transported him to Concord Hospital.
The man reportedly told police that earlier in the evening, he was hanging out with friends and Miller, who was just released from prison, and everyone agreed to meet up later at the restaurant.

At the bar, the man was playing pool with Miller and some other people he didn’t know and eventually, lost the game, which allegedly angered Miller. Miller, the man alleged, “punched me in the face for no reason,” according to the report.
Bar patrons separated the two men and both left the establishment.
Later, police spoke with Miller who reportedly admitted to being at the bar and that he was kicked out but he wasn’t sure why. He reportedly said it might have been because the manager thought he had drunk too much alcohol at the time. Miller though allegedly denied punching the man.
Two witnesses who both work for the bar reported that they were allegedly being hassled by Miller because they would no longer serve him and he was being rude. Miller allegedly yelled at the women and they stated that the man told Miller to leave the staff alone. That was when Miller punched the man, they alleged.
They reportedly identified Miller in a lineup.
The reporting officer later obtained medical records from the hospital and determined that the man had suffered a “left eye blunt injury with hyphema, elevated intraocular pressure, and medial wall orbital blowout fracture with media rectus muscle entrapment.”
The reporting officer stated that the medical report gave him just cause to take out a warrant for Miller’s arrest, which was done on May 1.
On May 12, Miller was arrested and held on $10,000 cash bail.
