Man Accused Of Killing Dog During Home Invasion Arrested In Concord

CONCORD, NH — Concord police, SWAT, and the U.S. Marshals Service arrested a Manchester home invasion suspect on Saturday with a violent criminal history who was accused of killing a dog during a burglary in March.
On March 21, Manchester police were called to an apartment on Orange Street in the central part of the city for a report of a shooting. When they arrived, they learned a suspect had burglarized an apartment while shooting and killing a dog, Heather Hamel, the public information officer for the Manchester Police Department, said.
“Through the course of the investigation, police learned that a man known to the victims forced his way into the apartment,” she said. “Almost immediately, he began shooting and, in the process, a dog was shot and killed.”

One of the tenants tried to escape by diving through a second-floor glass window during the shooting. He was seriously injured while trying to escape the incident, Hamel said.
During the past two and a half weeks, police investigated the incident and issued a warrant for the arrest of Marcos Nieves, 45.

On Saturday, Nieves was arrested on East Side Drive in Concord by police, the Central NH Regional SWAT Team, and the U.S. Marshals Service. He was charged with burglary, criminal threatening, armed career criminal, felon in possession, animal cruelty, and three counts of reckless conduct.
“We are very thankful for the assistance we received from Concord Police, the Central NH Regional SWAT team, and the U.S. Marshal Service,” Hamel said. “The collaborative efforts were instrumental in bringing this operation to a safe conclusion.”
Nieves' criminal history dates back to the mid-1990s when he was charged with multiple robbery counts as well as attempt, reckless conduct, and receiving stolen property. In April 1996 and January 2001, he was charged with reckless conduct and felon in possession out of Manchester. He was also charged with felon in possession in October 2006.
After an incident in Manchester in August 2015, Nieves was accused of first-degree assault, felon in possession, two drug possession counts, and two reckless conduct-deadly weapon counts after a shooting. He pleaded guilty to the drug charges, and the other charges were dropped in October 2015. He pleaded guilty later to possession of firearms and ammunition charges in U.S. District Court, receiving an 83-month prison sentence. In April 2016, $4,307.06 in drug money was forfeited to the state.
