Dispatch spoke to the witness – Gilmartin – who allegedly stated that he had just had an encounter with his wife on Wall Street, that she reportedly stated she was going to take her own life, and then sped off in a sedan. An officer was called to headquarters to take his statement but by the time the officer arrived, Gilmartin had left on his motorcycle. At the same time, dispatch received a call from Gilmartin’s ex alleging that he had just been at her home and threatened to kill her and her new boyfriend, according to a court affidavit.
A detective and the officer then went to Wall Street to speak to the couple about the incident.
The new boyfriend reported that Gilmartin had ignored divorce paperwork he had received and the pair argued for about an hour about their previous relationship. Gilmartin allegedly pulled a knife and threatened the harm couple as well as other things and they tried to calm him down, according to the report. He then folded the knife, put it in his pocket, but they continued to argue.
The woman grabbed her keys and left but Gilmartin allegedly followed behind and attempted to stop her but fell as she drove away, according to the boyfriend’s witness statement.
Gilmartin allegedly returned to him and threatened him again with the knife, according to the report. He also alleged that his 2-year-old, who was walking around on the stairs near where they were arguing, was pushed away by Gilmartin as she tried to use his leg for balance, according to the report. The officer noted the toddler's scraped knees consistent with the witness statement.
“(The victim) said that Sean stayed for 20 more minutes and before finally leaving, he told (the victim) to die a painful death,” according to the affidavit.
Warrants were then issued for Gilmartin’s arrest.
Second incident
About 24 hours later, police were sent to area of Wall and South streets for a report of a domestic incident and when they arrived, reportedly found Gilmartin “sitting on the hood of his very distraught ex-wife’s car” and facing off with her new boyfriend, according to the reporting officer.
In the court affidavit, the officer noted that she was familiar with the situation since she had been searching for Gilmartin on active warrants from the evening before. The officer stated that Gilmartin’s car was parked perpendicular in front of her car, blocking the intersection and her vehicle, according to the report.
The officer ordered Gilmartin to move away from the car and he allegedly reached into his pocket and threw two knives on the ground, according to the report. He was then cuffed for officer protection and placed in a cruiser.
The officer spoke to the wife and her new boyfriend who stated, according to the report, that Gilmartin had used one of the knives that he had just thrown on the ground to threaten them the night before. She alleged that she was out getting groceries earlier and when she drove onto West Street, “she was abruptly cut off at the intersection of South Street by Sean,” according to the report. He allegedly grabbed onto the vehicle and began screaming at her so she called police and texted her boyfriend.
Gilmartin was arrested and held on cash bail. A stalking charge was also added due to the two alleged incidents occurring within 24 hours, according to the report.
During an inventory search of Gilmartin’s car, an officer reportedly found a machete, a hatchet, two military flak jackets, and two military Cevlar helmets.
