Officers were sent to an apartment on Fisherville Road for a report of a domestic incident, according to an arrest report.

The officers met with a woman and her fiancée who appeared to be visibly shaken. The woman stated that she had sole custody of their child via court order and Licata was not to be around. However, he reportedly found out where she was living, allegedly showed up at the apartment without notice, and was demanding to see the child.

When the woman refused, he allegedly put his foot in the doorway and tried to hold the door open, according to the report. She then pushed him out and closed the door. After that, Licata allegedly kept banging on the door, yelling, and swearing.

“(The woman) stated that she was scared and she didn’t know what to do now that Licata knew where she lived,” the report alleged.

The officer noted damage to a door including small dents and one large dent where in an area that someone would either knock or bang to get inside, according to the report.

The officer spoke to two witnesses about the incident that described what they heard and saw and a 12-hour hold was issued for Licata. The officer also tried calling him and left a phone message.

Later, Licata reportedly called the officer and gave his side of the story stating that he had received court paperwork saying he could see his child. He reportedly found out about the mother’s new apartment through friends and went to the home. Licata allegedly denied touching the door. The officer asked to speak to Licata’s wife who was also a witness but her phone was busy.

The officer requested Salem Police go to the home to arrest Licata but he allegedly didn’t answer the door when they arrived. The officer then called him back and asked why he refused to answer the door.

“Licata stated that he was not home,” the officer alleged. “I asked Licata how he knew the police were at his house if he was not home.”

The two went back and forth about the incident and Licata allegedly denied damaging the door saying he didn’t do anything.

Licata then put his wife on the phone to talk to the officer about the incident and she alleged that Licata was attacked and was also threatened with violence. When asked why they didn’t file a report about the assault and threat, she reportedly stated that they just left and removed themselves from the situation. She then agreed to drive Licata back to Concord so he could turn himself in.

Licata is due in court on Sept. 21.
