According to arrest reports and a court affidavit, an officer and a detective were sent to a domestic on Alton Woods Drive at just after 5 p.m. on Sept. 24.
When they arrived, Whelpley reportedly answered the door. He was reportedly holding a phone and stated to the officer, “Are you going to arrest me?” The officer said they would be investigating the call to sort out what happened and a woman emerged at the door.

The officer and detective attempted to separate the parties – requesting that the woman step into a bedroom but she went to the porch to smoke a cigarette. Whelpley reportedly followed her and kept speaking to her. The officer told him to hang up the phone and step off the porch but he allegedly would not comply, so the officer removed the phone from his hand and disconnected it. Whelpley was also placed in handcuffs and told he was being detained and removed from the apartment so they could speak with the woman.
The officer asked the woman, Whelpley’s girlfriend, what happened and she alleged that he had broken her PlayStation Portable games. The officer inspected one of the games and saw that it was cracked. When asked who bought them, she said she did. When asked if they were gifts, she stated, “No, they are mine,” according to the report.
After finding out that Whelpley would be arrested, she attempted to recant her story and began to get upset but then reportedly stated again that they were her games.
Whelpley was arrested and given a court date of Nov. 2.
Four days later, he was arrested again after an officer was tipped off that Whelpley might be breaching his bail.
The tipster, a relative of the Whelpley’s girlfriend, stated that he thought he was in the apartment, allegedly against his bail conditions.
Police went to the apartment with the man and allegedly found Whelpley sleeping in a bed in his girlfriend’s room. He was arrested and held without bail.
