MERRIMACK, NH — A teenager from Concord, with a slew of arrests during the past couple of months, now faces felony charges in superior court after an incident in Merrimack on Wednesday.

Around 11:30 a.m., police were sent to the Polo Ralph Lauren Factory Store at the Merrimack Premium Outlet mall for a report of a robbery. A staffer told police a black man with a handgun in his waistband had robbed the store and threatened an employee. The suspect was wearing a black sweatshirt with the word “Zlone” across the chest, blue pants, and a black face covering. Lt. Chris Spillane of the Merrimack Police Department said officers checked the area but were unable to find a suspect.

“After speaking with employees and witnesses, it was learned that the suspect entered the store and immediately started filling large bags with clothing,” he said. “The employees approached the suspect and were able to retrieve the large bags of merchandise from him. The suspect then filled another large bag with merchandise and started walking towards the exit doors.”

One employee stood by the doors and asked the suspect if he was going to pay for the items. The suspect, later identified as Moise Ndutiye, 18, of Jennings Drive in Concord, “pulled up his sweatshirt and displayed a firearm that was located in his waistband,” Spillane said.

“The suspect then grabbed the firearm and threatened to kill the employee before leaving the store,” he said.

In an affidavit, police accused Ndutiye of yelling, “I will shoot you,” “I will kill you,” “I will kill you first,” and “I will come back and shoot everyone,” at the store employee.

The value of the clothing was more than $2,900, according to a court affidavit.

Detectives processed the scene and while doing so, the store manager in Merrimack received a call from a Polo Ralph Lauren store manager in Tilton about 90 minutes later. Police there had detained a man after an incident in that store, Spillane said.

“After speaking with the officers on scene in Tilton, it was clear that it was the same male suspect involved in the Merrimack investigation,” he said.

Tilton police then arrested Ndutiye. He was charged with robbery, criminal threatening, theft by unauthorized taking, and attempted theft charges, all felonies. Charges out of Tilton were unknown at post time.

After being arrested in Merrimack, Ndutiye was arraigned on March 3 in Hillsborough County Superior Court South. He was held on preventive detention. Ndutiye is due back in superior court for a dispositional conference hearing on April 19.

Ndutiye, about two weeks before, was arrested in Londonderry after being accused of shoplifting at the New Hampshire Liquor and Wine Outlet on Rockingham Road. He was arrested just before noon on a criminal trespass charge and a warrant. Ndutiye was arrested on Jan. 31 on theft by unauthorized taking, theft of services, and breach of bail charges after an incident on Jennings Drive in Concord. He was arrested nine days before that incident on theft and intoxication charges as well as a warrant after an incident at the liquor store on Storrs Street. On Jan. 7, Ndutiye was arrested on a felony theft charge after an incident at Rite Aid on North State Street.
