Jury Finds Former Nashua Resident Guilty On Rape, Sexual Assault, Unlawful Interception Charges

Follow-up: Michael Borges of Lewiston, Maine, raped a woman and recorded the sexual assaults across several hours in late November 2023.

NASHUA, NH — A man from Maine, who previously lived in Nashua, was found guilty of rape and sexual assault charges in late February, according to the Hillsborough County Attorney’s Office.

Michael Borges, 46, of Lewiston, Maine, was found guilty of aggravated felonious sexual assault, felonious sexual assault, and unlawful interception of an oral communication charges by a jury on Feb. 26. He raped a Gate City woman and illegally recorded the assaults across several hours on Nov. 23 and Nov. 24, 2023.

The jury reviewed the recording and determined the victim was physically helpless to resist and was assaulted before she had a chance to flee or resist. He was found guilty on three counts of aggravated felonious sexual assault-sexual intercourse, two counts of sexual assault-touched buttocks, and one count of unlawful interception. Borges was found not guilty on one aggravated felonious sexual assault-sexual intercourse count, four counts of aggravated felonious sexual assault-cunnilingus, and three counts of sexual assault-touched breast, according to court records.

Borges’ defense attorney requested a motion for judgment notwithstanding the verdict (set aside) due to “The complainant had no memory of the actions that resulted in the charging of eight AFSAs” and the jury rejected many of the counts.

“In his statements, the defendant admits to engaging in both penetration and cunnilingus with the complainant, with his defense being consensual intercourse with a previous intimate partner,” the motion stated. “No rational trier of fact could have found on the evidence presented that the defendant was guilty of penetration intercourse but not guilty of cunnilingus.”

The request, however, was “respectfully denied” by Judge Andrew Schulman.

“… courts do not vacate guilty verdicts because they are seemingly at odds with the same jury’s acquittals,” he wrote. “Further, the evidence of sexual intercourse was supported by the defendant’s details and graphic verbal admissions on the audio… the verdicts are not inconsistent at all, but are, rather, suggestive of a diligent application of the standard of proof.”

Borges will be sentenced in Hills South on May 8.

This case was prosecuted by Assistant County Attorneys Samantha Fairbanks and John Harding along with Victim/Witness Advocate April Aucoin.

According to superior court records, Borges pleaded guilty to a felony charge of forged or false prescription in May 2012. He received a 12-month jail sentence and a $434 fine, both of which were suspended for three years. Borges was also given 13 days of time served credit and was on probation for a year.
