NASHUA, NH — A Nashua man was arrested Tuesday on felony charges of assaulting his 5-month-old child. Xavier Luna, 24, is charged with causing serious, but not life-threatening, injuries to the infant while the 5-month-old was in his care Monday night.

Luna, of Beard Street, was charged with one count of first-degree assault and one count of second-degree assault. He was held without bail.

Nashua Police said they responded to the Southern New Hampshire Medical Center Tuesday morning after the infant was admitted to the hospital with suspicious injuries. Police said their investigation determined the injuries were sustained the night before while the infant was under Luna's care at a Nashua residence and that the injuries were not accidental in nature.

The Class A Felony first-degree assault is punishable by up to 15 years imprisonment, exclusive of fines. A Class B Felony second-degree assault is punishable up to seven years imprisonment, exclusive of fines. Luna was scheduled to appear at arraignment at the Hillsborough Superior Court-South on Wednesday.
