An investigation revealed that Vining had been driving on the southbound shoulder of Fairview Avenue, where the pedestrian was walking, at the time of the accident, police records show.
Additionally, Vining told police that his windshield had been “fogged up” and obstructed his vision, blocking him from seeing the person on the shoulder, an affidavit reads.
Vining was charged with reckless vehicular homicide on Wednesday. He also faces several motor vehicle offenses.
He was released on pre-trial monitoring and is scheduled to appear in court on March 23.
