Cinnaminson Man Indicted In Fatal Shooting: Prosecutor

Xavier Myers was indicted on a count of aggravated assault in the murder of Eric Thomas II. He was one of two men indicted.

CINNAMINSON, NJ — A Cinnaminson man has been indicted in connection with the fatal shooting of an Eastampton man in Burlington City earlier this year, Burlington County Prosecutor Scott Coffina said Wednesday night. Xavier L. Myers, 19 at the time of his arrest, of the 700 block of South Worrington Avenue, was indicted on one count of third-degree aggravated assault. He is one of two men indicted in the murder of 30-year-old Eric Thomas II.

Irie Y. Simmons, of Pennsuaken, was indicted on one count of murder in the first-degree, second-degree possession of a weapon for an unlawful purpose and second-degree unlawful possession of a weapon. He was 18 at the time of his arrest.

Police say Myers and Simmons approached Thomas at about 10:40 p.m. on Saturday night, Jan. 21, near the intersection of East Broad and Library streets in Burlington City. After the shooting, police say they fled the scene, but were captured by police in the area a short time later.

Thomas was taken to Lourdes Medical Center of Burlington County in Willingboro, where he was pronounced dead at 11:29 p.m.

Police officers from the Burlington City, Burlington Township, and the Burlington County Bridge Commission police departments responded to the scene of the shooting.

Myers and Simmons were arrested within hours of the shooting. A Superior Court judge ordered Simmons to be detained following his arrest, while Myers was released. The firearm believed to be used in the shooting has been recovered.
