NJ Man Accused Of Killing NHL Star, Brother Faces New Charges In Indictment

Sean Higgins could now face an even longer prison sentence if he's convicted in the deaths of Johnny and Matthew Gaudreau.

SALEM, NJ — The man accused of fatally striking NHL star Johnny Gaudreau and his brother while driving drunk faces new charges in an indictment filed Wednesday.

Sean M. Higgins was indicted on two count of aggravated manslaughter (first-degree), two counts of reckless vehicular homicide (second-degree), leaving the scene of a deadly accident (second-degree) and tampering with physical evidence (fourth-degree).

Higgins was arrested in late August after authorities say he struck and killed Johnny Gaudreau, 31, and Matthew Gaudreau, 29, as the victims rode bicycles in Salem County.

He was initially charged with two counts of second-degree death by auto and faced up to 20 years in prison.

Higgins, 44, of Woodstown, now faces additional charges, including first-degree aggravated manslaughter — punishable by up to 20 years in prison for each count.

A post-indictment arraignment hearing is set for Jan. 7.

Richard F. Klineburger III, an attorney representing Higgins, said they're awaiting additional evidence before commenting on the indictment.

"It would be unfair to both Mr. Higgins as well as the general public to make a statement until a full evaluation and review has been completed," Klineburger told Patch via email. "We understand the public's interest in this matter, and we appreciate the media's patience and respect for the ongoing investigation. We will provide additional information and statements in the future, as appropriate."

Johnny was a seven-time NHL all-star who played for the Columbus Blue Jackets at the time of his death. Matthew played in the minor leagues before returning to South Jersey and coaching.

The deadly incident sent shockwaves throughout the NHL's fandom and has received widespread attention.

The Gaudreaus grew up in Salem County and lived there at the time of their deaths.

They were set to be groomsmen at their sister's wedding, which had been scheduled for the day after they died. Both of their wives were also pregnant at the time of their deaths.

Higgins has been incarcerated in Salem County Jail since his Aug. 29 arrest.
